TD Ameritrade data breach class action lawsuit overview:ย

TD Ameritrade failed to protect and safeguard its customersโ€™ personally identifiable information during a May data breach that occurred following a cyber attack against the MOVEit file transfer software, a class action alleges.ย 

Plaintiff Fortuno Jeanfort claims TD Ameritrade has a legal and equitable duty to protect and safeguard personally identifiable information it โ€œobtains, collects, uses, and derives a benefit fromโ€ in carrying out its business.ย 

Jeanfort argues the TD Ameritrade data breach occurred after an unknown actor was able to access files belonging to the company that were saved on the MOVEit server, something he claims was the result of negligence on behalf of the financial services company.ย 

โ€œDue to Defendantโ€™s negligence, cybercriminals obtained everything they need to commit identity theft and wreak havoc on the financial and personal lives of thousands of individuals,โ€ the TD Ameritrade class action states.ย 

Jeanfort wants to represent a nationwide class of individuals who received a data breach notice from TD Ameritrade on or around Aug. 3, 2023, informing them that their personally identifiable information may have been accessed or acquired.ย 

TD Ameritrade data breach exposed Social Security numbers, names, other private information, class action says

Personally identifiable information exposed in the TD Ameritrade data breach included names, Social Security numbers, financial account information, dates of birth, government identification numbers and other personal identifiers, according to the TD Ameritrade class action.ย 

โ€œFor the rest of their lives, Plaintiff and the Class Members will have to deal with the danger of identity thieves possessing and misusing their Personal Information,โ€ the TD Ameritrade class action states.ย 

Jeanfort claims TD Ameritrade is guilty of unjust enrichment, breach of covenant of good faith and fair dealing, invasion of privacy, breach of confidence, breach of fiduciary duty, breach of implied contract, negligence and negligence per se.ย 

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and punitive damages for himself and all class members.ย 

In another case involving TD Ameritrade, the company agreed in July 2022 to pay more than $2.3 million to end claims it breached its contract with its account holders by providing substitute payments instead of dividends without giving compensation for any potential difference.ย

    yep Aug. 31 all my information in TD Ameritrade was hacked, instead of my account being transferred to Charles Schwab it was transferred to Apex Corporation Co then transferred to Ally Invest ~ Identity fraud, they had my name, address, SS#
    I discovered it when I got Sept. statement from CS and there was 120,000 missing. It was an ordeal to track down what happened. My financial advisor asked if I transferred the money. NO ~ I had to do all the phone calls to figure out where everything went. Now I know TD was hacked in May ~

    I was scammed in May, 2023 so shrewdly that I was told i was part of a criminal investigation and I needed to move my money out of TdAmeritrade as quickly as I could. I thought I was working with the IRS and the FTC and I transferred roughly 250,000 to wherever i was told to put the money. The scam started with a phone call on May 11, 2023 and continued until mid June.

    I donโ€™t recall receiving email notification about the data breach, however, my financial information got compromised as I had to deal with identity theft back in May 2023 with my checking account associated with the TD accounts I have. I also got credit card compromised. I had fraudulent charges on both accounts and spent a lot of time on fixing all that mess and trying to recover the money stolen from me.
