Scripps agreed to a class action lawsuit settlement to resolve claims it failed to protect patients from a 2021 data breach.

The settlement benefits individuals who received a notice of the 2021 Scripps ransomware attack.

Scripps faced several class action lawsuits from consumers affected by a 2021 data breach. According to the consolidated cases, Scripps failed to prevent a ransomware attack that compromised sensitive health information.

In April 2021, Scripps — a San Diego health system — reportedly learned of a ransomware attack that compromised the data of nearly 150,000 patients across the country. The breach affected data such as names, dates of birth, health insurance information, health data and more.

Scripps has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.

Under the terms of the settlement, class members can receive cash payments. 

The settlement allows all class members to claim a cash payment of up to $100, even if they did not experience documented out-of-pocket expenses. Class members who can document expenses such as bank fees, communication charges and more can receive up to $1,000. Class members who experienced extraordinary expenses such as identity theft or fraud due to the data breach can receive additional compensation of up to $7,500. Actual payments may be increased or decreased based on the number of participating class members.

All class members are eligible for three years of free identity theft protection through IDentity Defense Total and three years of fraud resolution services through Pango ID Theft Protection.

The deadline for exclusion and objection is March 8, 2023. 

The final approval hearing for the Scripps data breach class action lawsuit settlement is scheduled for April 7, 2023.

Class members do not need to submit a claim to collect credit-monitoring benefits. Instead, they can receive these benefits using the enrollment code provided on their notice after the settlement is finalized. Class members can set up a registration reminder on the settlement website.

Class members must submit a valid claim form to receive a settlement payment. Claims in the settlement are due by March 23, 2023.
