Rivers Casino data breach class action overview:

A Philadelphia casino’s negligence led to a data breach exposing the private information of its employees, a new class action lawsuit alleges.

Plaintiff Brett Nelson, an employee of Rivers Casino Philadelphia, filed the class action complaint against its operators, Rush Street Gaming LLC and Sugarhouse HSP Gaming L.P. on Jan. 8 in a Pennsylvania federal court.

The lawsuit alleges that the casino operators violated data protection laws and failed to implement adequate security measures to protect sensitive data stored in their IT systems. This led to a data breach that the Casino didn’t publicly disclose until Dec. 30, more than a month after the breach was confirmed, Nelson alleges.

Nelson says the breach compromised employees’ names, Social Security numbers and bank account details used for direct deposit.

“Defendants failed to take precautions designed to keep individuals’ Private Information secure,” the lawsuit alleges.

Rivers Casino data breach was preventable, lawsuit alleges

Nelson says the breach occurred after an unauthorized third party accessed and exfiltrated files from the casino’s network.

He says he has experienced an uptick in spam calls and emails since the breach, and alleges that he and other affected individuals now face a heightened risk of identity theft. 

“Defendants, despite having the financial wherewithal and personnel necessary to prevent the Data Breach, nevertheless failed to use reasonable security procedures,” the lawsuit says.

As a result, Nelson is looking to represent anyone in the United States whose information was also exposed in the Rivers Casino data breach. 

He is suing for negligence, unjust enrichment, and breach of implied contract, and seeking certification of the class action, damages, fees, costs, a jury trial and an order forcing the casino to improve its data security practices. 

In 2022, another casino, MGM Resorts International was hit with a class action lawsuit alleging it refused to refund cash change to individuals gambling at its casinos, reaping “millions of dollars in profits” by shortchanging thousands of its casino players.
