Reproductive Biology Associates (RBA) and MyEggBank (MEB) agreed to a $1 million class action settlement to resolve claims that they failed to prevent a 2021 data breach that compromised patient information.
The settlement benefits consumers who received a data breach notice from Reproductive Biology Associates and/or MyEggBank North America or consumers whose personal information was compromised in an RBA/MEB data breach between April 7 and 10, 2021.
Between March 25 and April 16, 2021, a third party allegedly gained access to RBA and MEB’s computer systems, compromising thousands of patients’ personal data and health information. Plaintiffs in the class action lawsuit claim the reproductive clinics could have prevented the data breach by implementing reasonable cybersecurity measures.
Reproductive Biology Associates is a fertility clinic in Atlanta. MyEggBank is a national network of donor egg banks.
Reproductive Biology Associates and MyEggBank haven’t admitted any wrongdoing but agreed to a $1 million settlement to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members who file a valid and timely claim will receive a proportionate share of the net settlement fund after the attorneys’ fees, administration costs and other expenses are deducted.
The deadline for exclusion and objection is April 5, 2024.
The final approval hearing for the settlement is scheduled for May 23, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by April 30, 2024.
Who’s Eligible
Consumers who received a data breach notice from Reproductive Biology Associates and/or MyEggBank North America or consumers whose personal information was compromised in an RBA/MEB data breach between April 7 and 10, 2021.
