Calmark Group agreed to pay $385,200 to resolve claims that it violated the Illinois Biometric Information Privacy Act (BIPA) by collecting employee fingerprints through timekeeping clocks.

The settlement benefits current and former Calmark Group employees who used a hand- or finger-scanning time clock at Calmark’s Illinois facilities without providing written consent between Feb. 16, 2018, and June 7, 2019.

According to the class action lawsuit, Calmark Group failed to get employee consent before collecting and storing their biometrics such as fingerprint and hand scans. Plaintiffs in the case claim Calmark’s conduct violated BIPA.

Calmark Group is a manufacturing, mailing and marketing group.

The company hasn’t admitted any wrongdoing but agreed to a $385,200 settlement to resolve the Illinois BIPA class action lawsuit.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Each claimant is estimated to receive around $663, though actual payments may be higher or lower depending on the number of claims filed.

The deadline for exclusion and objection is Feb. 28, 2024.

The final approval hearing for the Calmark Group settlement is scheduled for April 3, 2024.

In order to receive a settlement payment, class members must submit a valid claim form by May 18, 2024.
