  • Why: Miller alleges the company is responsible for a data breach that exposed 20,000 employees’ data.
  • Where: The Propark data breach class action was filed in a Connecticut federal court.

Propark, a Connecticut-based parking management company, is facing a new class action lawsuit alleging it is responsible for a data breach that impacted 20,000 of its employees.

Plaintiff Walter Miller filed the class action complaint against Propark LLC on Sept. 24 in a Connecticut federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, the breach was discovered on or around Jan. 15, when an unauthorized actor gained access to Propark’s computer systems.

The compromised information, which includes names, Social Security numbers, birth dates, and dependent details, was part of the company’s employment records.

The lawsuit claims that Propark failed to implement sufficient cybersecurity measures to protect its employees’ sensitive data. The breach has left many employees vulnerable to identity theft and fraud, with the stolen information potentially being sold on the dark web, Miller says.

Propark operates more than 1,000 parking locations across the United States, the lawsuit says,

According to the complaint, the company neglected to establish proper safeguards, such as data encryption and employee training, to prevent unauthorized access to its systems.

Miller also alleges that Propark was slow to detect the breach, which may have worsened the consequences for those affected.

“Propark collected and stored our personal data, and we trusted them to keep it safe,” Miller says in the lawsuit. “But instead, our information is now in the hands of cybercriminals.”

Propark’s negligence left employees vulnerable, lawsuit claims

The complaint alleges Propark’s actions—or lack thereof—amount to negligence, leaving employees exposed to potential identity theft for years to come.

As a result of the data breach, employees impacted by the incident are now advised to closely monitor their financial accounts for any signs of fraud, Miller says.

Many have already spent “considerable time and money” on mitigation efforts, such as signing up for credit monitoring services and changing passwords, he adds.

The lawsuit claims that Propark’s inadequate security practices have caused significant harm, both in terms of financial costs and emotional distress. As a result, Miller is looking to represent anyone whose information was revealed in the data breach. He’s suing for negligence and violation of privacy laws, and is seeking certification of the class action, damages, fees, costs and a jury trial.

Consumers recently filed class action lawsuits against Ally Financial, Acadian Ambulance, National Public Data, Cricket Wireless, Rite Aid and AT&T due to recent data breach incidents at the companies.
