Mr. Cooper data breach class action lawsuit overview: 

  • Who: Nancy Randall filed a class action lawsuit against Mr. Cooper Group Inc. 
  • Why: Randall claims Mr. Cooper failed to protect the personally identifiable information of its customers during a data breach purportedly discovered by the mortgage lender at the end of last month. 
  • Where: The class action lawsuit was filed in Texas federal court. 

Mortgage corporation Mr. Cooper failed to protect the personally identifiable information (PII) of its customers during a data breach discovered by the company at the end of last month, a new class action lawsuit alleges. 

Plaintiff Nancy Randall claims Mr. Cooper was obligated by industry standards to safeguard any information in its systems containing PII, yet allegedly failed to do so during a data breach event it purported to discover on Oct. 31. 

Randall argues Mr. Cooper also failed to provide timely, accurate and adequate notice to inform herself and other class members that their PII allegedly had been compromised during the data breach. 

“The security incident was wide-reaching, impacting a number of the Defendant’s computer systems and compromising the PII of millions of people,” the Mr. Cooper class action states. 

Randall wants to represent a nationwide class and Washington subclass of individuals who had their PII maintained by Mr. Cooper and were sent a notice regarding the data breach. 

Mr. Cooper failed to implement, follow ‘basic security procedures,’ class action says

Randall argues her and other class members PII is now “in the hands of criminals” due to an alleged failure by Mr. Cooper to “implement and follow basic security procedures.” 

“Consequently, Plaintiff and Class Members have had to spend, and will continue to spend, significant time and money in the future to protect themselves due to the Defendant’s failures,” the Mr. Cooper class action states. 

Randall claims Mr. Cooper is guilty of unjust enrichment, breach of implied contract, negligence, negligence per se and is in violation of the Washington Consumer Protection Act

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, statutory, treble and/or punitive damages for herself and all class members. 

In March, Nationstar — which is now known as Mr. Cooper — agreed to pay $5 million to end claims it sent incorrect automated clearing house entries to the bank accounts of mortgage borrowers in April 2021.

    I am a Mr Cooper customer. I found out when I tried to pay my mortgage payment November 2023. They stated that they were having trouble with website and to check back. I checked every day at some point they said they had a data breach and not to worry if our mortgage was paid late, which I did not want. I kept trying back and finally paid on the 8th I think. I am very worried about the data breach. I am in South Carolina

    I found out when I got a letter in the mail telling me about the breach and that I had a new lender.

      I received a letter of the breech which I figured out before the announced date of 10 31. I couldn’t access my info on the 30th. I’ve gotten several calls and emails regarding loans etc I want to join the lawsuit they r a horrible company. They messed up my account even tho I had legal documentation they refused to fix their error until I got an atty involved they r horrible!!!

      I received notice when I tried to make my November payment. I couldn’t get on site. Then found out I had to go to rushmore servicing to make my house payment. How do I get in on the data breach lawsuit.

      We are really worried about Identity Theft as well. I’m also wondering how to get the ID theft protection/monitoring. Does Mr Cooper refund the cost or how do I go about that to do it correctly?

    I went to make my mortgage payment online on 9 November and was notified. There was a problem. Later I received an email about a data breach.

    I found out about the data breach when I tried to pay my mortgage on the 1st. They made it look like there was no issue with my personal data. I had to keep checking each day until I could pay. Mr Cooper collected more interest money from me! They wrote I would not be penalized for not paying on time and my credit score would not be affected. Irony, they allowed criminals to attack my personal data and mess with my credit score. I am 66 and very worried. I have not received any letter in the mail notifying me of the data breach! I found out from YouTube I Allegedly.

      I found out as well when I tried to pay my mortgage electronically. On or about the 9th I was able to pay. I got a communication about the breach in an email after I paid but haven’t received any update on the damage or current security of my PII. I’m not sure at this point how to proceed to ensure I’m protected other than having notifications turned on via the credit bureau. What will Mr Cooper do now? Any thoughts on what more I should be doing?

    I received an email about the breach. It was about a week before I could pay my mortgage. I pay via saved bank account. Now I’m really paranoid my accounts are at risk. I’ve had this happen before but that company gave me a free year of monitoring my personal data, Mr, Cooper did not.

    I never received an email. I found out when I tried to log on my account to pay my mortgage and I couldn’t. I couldn’t reach anybody and I’m worried now about my credit score.
