DPP, doing business as Home Care Providers of Texas, agreed to a $1.4 million class action lawsuit settlement to resolve claims that a 2022 data breach compromised millions of patients’ information.
The settlement benefits individuals whose personal information was potentially compromised by the 2022 Home Care Providers of Texas data breach.
The data breach reportedly occurred in June 2022, though it was not disclosed until January 2023, and compromised names, birth dates, Social Security numbers and protected health information. The class action lawsuit claims Home Care Providers of Texas could have prevented the cyberattack if it had implemented reasonable cybersecurity measures.
DPP LLC, which does business as Home Care Providers of Texas, is a Texas-based provider of at-home care, such as home nursing.
DPP hasn’t admitted any wrongdoing but agreed to a $1.4 million settlement to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can receive up to $5,000 in reimbursement for losses related to the data breach, such as credit expenses, bank fees, unauthorized charges, travel expenses and more. Class members can also seek reimbursement for up to five hours of lost time, compensated at $25 per hour, for a maximum lost-time payment of $125.
If funds remain in the settlement fund after class member reimbursement claims are paid, claimants may receive a residual cash payment estimated to be around $50. Actual residual payments may be higher or lower depending on the number of claims.
The deadline for exclusion and objection is Jan. 28, 2024.
The final approval hearing for the settlement is scheduled for April 29, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by Feb. 27, 2024.
