Fidelity Investments failed to adequately protect its computer network during a “massive and preventable” data breach in August, a new class action lawsuit alleges.
Plaintiffs Yaakov Gluck and Steven Gluck’s class action lawsuit claims the Fidelity data breach allowed cybercriminals to steal “everything they could possibly need” to commit “nearly every conceivable” form of identity theft.
“Because Defendant presented such a soft target to cybercriminals, Plaintiffs have already been subjected to violations of their privacy, fraud, and identity theft, or have been exposed to a heightened and imminent risk of fraud and identity theft,” the data breach class action says.
The Glucks want to represent a nationwide class of consumers who had their data compromised during the data breach.
The data breach exposed Social Security numbers, financial information, names, phone numbers and addresses, the Fidelity class action alleges.

Yaakov Gluck and Steven Gluck argue Fidelity failed to implement “adequate and reasonable” measures to ensure their computer systems were protected and failed to take adequate steps to prevent and stop the breach.
The class action lawsuit further argues Fidelity failed to timely detect the data breach and failed to honor their “repeated promises” to protect the consumers’ personal information, among other things.
“Due to the Data Breach, Plaintiffs have experienced anxiety over the public release of his personal information, which he trusted would be safeguarded against unauthorized access and disclosure,” the data breach class action says.
Yaakov Gluck and Steven Gluck allege Fidelity is guilty of negligence and negligence per se and invasion of privacy. The plaintiffs demand a jury trial and request declaratory and/or injunctive relief and an award of actual, statutory and punitive damages for themselves and all class members.
A pair of consumers filed a similar class action lawsuit earlier this year against Fidelity over claims the company and its subsidiary LoanCare failed to properly safeguard and secure the personally identifiable information of consumers during a data breach announced by Fidelity in December 2023.

I was affected by the data breach. How can I be apart of the lawsuit
My Fidelity accounts were compromised around that time and I still haven’t got my money back. It’s over 50k and I notified them when it all started and even put a freeze on my account. The way I had them set it up was that know one could withdraw funds unless it was me over the phone ( they used the voice recognition service). I had some extremely bad luck during the next year with getting hacked and health issues so I haven’t taken the time to get to the bottom of this. Hopefully there is a chance. I never received a notice or anything. I was just thinking about it and decided to Google if they had a security breach during that time period.
I was hit by this while on tour of Iceland, suffered major hits on my accounts too include my checking account at Wells Fargo and to my Fidelity cash account and even was able to buy Crypto by transferring money from my IRA account. Took months to try and straighten this up and I still believe it’s not correct. I have been paying $25 a month since thru Experian for protection. Please add me too list.

I was affected my ss number was used
I have received papers in the past from them for my liking investments. I received no notice of a data breach, unfortunately that’s the big question is if my information was compromised. May not know for years…
I have 401k thru contractors Warehouse and was affected.
I “had” 401 k. DSC logistics Santa Fe springs, CA. When I first called inquire about money I had invested. Was told I had no money. Said I had cashed out. No way! When I called again said Call Mass Mutual. Company Not using fidelity. Mass mutual. Sent me in circles. Fidelity Funding. Was it data breach. All I know. Money I thought was secure. Safe. Told no matter what I would never lose money I put in. Only what fidelity matched. Every paycheck. Years. Until DSC closed moved to Mira Loma,ca. Most employees laid off. I was pregnant at time. I went back to schooL- medical field. We were told. Our money would always be there.. apparently that was a lie. Somehow. I lost every cent. I don’t know when I don’t know how. I know I feel robbed. Definitely. Someone has to know something.
