Carrington Mortgage Services and Alvaria Inc. failed to properly safeguard and secure the personally identifiable information (PII) of Carringtonโs customers during a March data breach, a new class action lawsuit alleges.ย
Plaintiff Pamela Smith claims Carrington, a fully integrated mortgage company with lending and services options, provided its customersโ PII to workforce engagement software and cloud service technology solutions provider Alvaria.ย
Smith argues Carrington and Alvaria did not have adequate security measures that complied with industry standards in place to protect the data and failed to provide Carrington customers with adequate notice about the data breach.ย
โPlaintiff brings this class action lawsuit to address Defendantsโ inadequate safeguarding and supervision of Class Membersโ Private Information that they collected and maintained,โ the data breach class action states.ย
Smith wants to represent a nationwide class and Illinois subclass of individuals who had their private information stolen during the March data breach on Alvariaโs customer environment.ย
Carrington customers affected by data breach at risk of future harm, class action alleges
Smith argues she and other class members would not have provided their private information to Carrington and Alvaria had they known the companies would โbreach their obligations, privacy promises, and agreements.โย
Further, Smith claims individuals affected by the data breach are now at risk of having a variety of crimes committed against them using their stolen data, including having fraudulent financial accounts opened in their names, among other things.ย
โThere has been no assurance offered by Defendants that all personal data or copies of data have been recovered or destroyed,โ the data breach class action states.ย
Smith claims Carrington and Alvaria are guilty of unjust enrichment breach of implied contract, breach of contract and breach of third-party beneficiary contract, and of violating the Illinois Consumer Fraud and Deceptive Business Practices Act.ย
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief, along with an award of actual and statutory damages for herself and all class members.ย
Last month, a California federal judge gave final approval to a settlement agreement worth nearly $20 million that resolves claims revolving around a 2020 Robinhood Financial data breach.

I was also apart of Carrington Mortgage data breach along with the extra fees for online payments among other things by this company. How do I joint this class action??
Carrington stated that my title was clouded because a Teresa Lionberger-Etzel was on my title as home owner, I donโt not know any by that name and only know of two people with that last name, my sister and myself. They were trying to have me submit an affidavit showing that myself and Teresa were the same person. Their own title department was responsible for this title mistake as I had not changed my name and made no suggestion that my title was incorrect. I only found out when I tried to refinance and was denied. I refused to submit and affidavit, I had just gotten married the year before and had submitted one for last name change and advised they should have that on file. They were stating they never received on even after I had provided proof that Carrington had physically mailed me in a Carrington envelope showing they received it. After I showed proof of them receiving the affidavit and acknowledging they received it, the magically found the submitted affidavit. I am still not sure if my title has been cleared as they have refused to answer me and have not responded to a single email.
I received a letter fro Alvaria regarding a data breach with Flagship credit acceptance, but that was it!
I got the Alvaria letter, but nothing from Carrington Mortgage Services.
