Carrington, Alvaria data breach class action lawsuit overview:ย

Carrington Mortgage Services and Alvaria Inc. failed to properly safeguard and secure the personally identifiable information (PII) of Carringtonโ€™s customers during a March data breach, a new class action lawsuit alleges.ย 

Plaintiff Pamela Smith claims Carrington, a fully integrated mortgage company with lending and services options, provided its customersโ€™ PII to workforce engagement software and cloud service technology solutions provider Alvaria.ย 

Smith argues Carrington and Alvaria did not have adequate security measures that complied with industry standards in place to protect the data and failed to provide Carrington customers with adequate notice about the data breach.ย 

โ€œPlaintiff brings this class action lawsuit to address Defendantsโ€™ inadequate safeguarding and supervision of Class Membersโ€™ Private Information that they collected and maintained,โ€ the data breach class action states.ย 

Smith wants to represent a nationwide class and Illinois subclass of individuals who had their private information stolen during the March data breach on Alvariaโ€™s customer environment.ย 

Carrington customers affected by data breach at risk of future harm, class action alleges

Smith argues she and other class members would not have provided their private information to Carrington and Alvaria had they known the companies would โ€œbreach their obligations, privacy promises, and agreements.โ€ย 

Further, Smith claims individuals affected by the data breach are now at risk of having a variety of crimes committed against them using their stolen data, including having fraudulent financial accounts opened in their names, among other things.ย 

โ€œThere has been no assurance offered by Defendants that all personal data or copies of data have been recovered or destroyed,โ€ the data breach class action states.ย 

Smith claims Carrington and Alvaria are guilty of unjust enrichment breach of implied contract, breach of contract and breach of third-party beneficiary contract, and of violating the Illinois Consumer Fraud and Deceptive Business Practices Act.ย 

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief, along with an award of actual and statutory damages for herself and all class members.ย 

Last month, a California federal judge gave final approval to a settlement agreement worth nearly $20 million that resolves claims revolving around a 2020 Robinhood Financial data breach.

    I never even got a response from Carrington and alvaria just the letter not even a sorry nothing they donโ€™t give 2 shits about any of us I had Carrington for years they love love to give late charges I even called them had a dumb ass trying to tell me payments are on the first had no idea about 16 days I kept saying a on 17 day late heโ€™s saying no the 1st so I said guess they hire anyone so now we know why identity was stolen calls hundreds of them every day scammer this is bullshit I hope they get what is coming to them or identify us priceless think they would at least gave a month free mortgage payment no 2 years of protection for identity is already sold you know I know

    I also received a letter from ALVARIAbut I have been so sick I just now glands through it and scanned this article but I canโ€™t comprehend it all my illness makes my brain foggy and my vision blurred now a migraine from trying to focus ugh I honestly have canโ€™t have more stress than I already haveโ€ฆ. I apologize I know itโ€™s not about health issues or anything like that but I am just so fed up itโ€™s not one thing itโ€™s another and I just donโ€™t know how much longer I can deal with all of this stuff.

    I also received this letter and I recently found but after this breach that someone is fraudulently using my SSN to have employment fraud

    We have been with Carrington for over 10 years and Iโ€™m sure they have ripped us off as well.

    Donโ€™t tell me that we are safe because my identity was stolen from alvaria and someone opened a Unemployment claim in my wife name they need your SS numbers so tell me thes that seem safe to you I donโ€™t think so

    I received a letter and now it appears someone received a social security check from my SSA account.

    I got the Alvaria letter, but nothing from Carrington Mortgage Services. I did not choose to do business with Carrington and do not wish to continue with this company. Consumers should not have their mortgages sold to companies without the customerโ€™s input, to some companies they never heard of or did not seek out.

    Please add me. I recently found out about this when I mostly check my credit report on a yearly basis. I saw an extra unfamiliar balance to my Carrington Mortgage account. The Carrington Reps could not give me an answer why the extra unfamiliar balance was on my credit report with Equifax via phone. Next thing I know within a week, I received a letter from ALVARIA that my information was breached which began on March 9, 2023 with Carrington Mortgage Service. It is sad that Carrington Mortgage Service never mentioned this to me before. SMH ๐Ÿ˜”

    Data breach ! This is getting ridiculous all this technology and itโ€™s just destroying people before one. I wondered why my name is plastered all over the information sites even child pedophile lists. Iโ€™m having a hard time with Carrington Mortgage as it is, I was passed over to them from my original mortgage company that I closed with a year and a half ago and Carrington went and upped my mortgage close to $500 and I canโ€™t make ends meet as much as I try and theyโ€™re not even willing to work with me these companies are something else financial institutes suck โ€ฆโ€ฆadd me to the list for sure.!!!
