Ascension Health cyberattack class action lawsuit overview: 

  • Who: Katherine Negron filed a class action lawsuit against Ascension Health. 
  • Why: Negron claims Ascension Health allowed a cyberattack to occur by failing to safeguard the personal information of its patients. 
  • Where: The Ascension Health class action lawsuit was filed in Illinois federal court. 

A new class action lawsuit claims Ascension Health bears responsibility for a cyberattack that exposed the personal information of thousands of its patients earlier this month. 

Plaintiff Katherine Negron’s class action lawsuit claims the cyberattack was due to a failure by Ascension Health to safeguard the information, including certain personally identifying information and protected health information. 

“Plaintiffs and Members of the Class have suffered significant injury and damages due to the Data Breach permitted to occur by Ascension, and the resulting misuse of their Personal Information and fraudulent activity,” the Ascension Health class action says. 

Negron seeks to represent a nationwide class and Illinois subclass of individuals whose private information was compromised as a result of the data breach reported by Ascension Health. 

Patients unable to access services in wake of Ascension Health data breach, class action claims

Negron argues Ascension’s patients are unable to use the health system’s services in the wake of the data breach as a result of its network systems being offline and inaccessible.

“Plaintiffs and Class Members are unable to effectively communicate with their healthcare providers and/or receive the requisite medical care and attention they need for months following the Data Breach,” the Ascension Health class action says. 

Negron claims Ascension Health is guilty of negligence, negligence per se, breach of implied contract and unjust enrichment, and violating the Illinois Consumer Fraud And Deceptive Business Practices Act

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, compensatory, statutory and punitive damages for herself and all class members. 

In a previous data breach involving a company named Ascension, a data analytics firm going by the same name suffered a data breach in 2019 that exposed the private information of millions of individuals.
