Advent Health Partners agreed to a $500,000 settlement to resolve class action lawsuit claims surrounding a 2021 data breach that compromised thousands of patients’ information.
The settlement benefits individuals who received a mailed notification that their information was potentially compromised in the September 2021 Advent Health data breach.
In September 2021, Advent Health Partners discovered a data breach that compromised the names, Social Security numbers, driver’s license information, birth dates, health insurance data, medical treatment information and financial account data of 61,072 patients.
Patients later filed a class action lawsuit against Advent, arguing the health system failed to protect their information through reasonable cybersecurity measures.
Advent Health is a Christian health system with 51 hospitals and hundreds of other care sites across nine states.
Advent Health hasn’t admitted any wrongdoing but agreed to a $500,000 class action settlement to resolve these allegations related to the data breach.
Under the terms of the Advent Health settlement, class members can receive payments of up to $750 for “ordinary” losses associated with the data breach. This includes bank fees, credit-related costs and up to four hours of lost time at a rate of $18 per hour.
Class members can receive larger payments of up to $5,000 if they experienced “extraordinary” data breach losses including actual, documented and unreimbursed monetary losses. This may include fraudulent charges that were not reimbursed by a bank or damages resulting from identity theft.
All class members can receive three years of free one-bureau credit monitoring through IDX. This service includes at least $1 million in identity-theft insurance and various other benefits.
In addition to providing cash benefits and credit monitoring, Advent Health agreed to improve its data security through Dec. 31, 2024, to better protect patient information from future attempted data breaches.
The deadline for exclusion and objection is March 21, 2023.
The final approval hearing for the settlement is scheduled for April 14, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by April 20, 2023.
