A consumer hit Advance America Cash Advance Centers Inc. with a class action lawsuit in the wake of a data breach that allegedly exposed the Personal Identifiable Information (PII) of those who used the companyโ€™s loan services.

Advance America is a company that provides cash advances and other loan services in the United States.

Plaintiff John Wilkinson Advance America claims recently informed him of the data breach, which reportedly took place around Feb. 7. An unauthorized user allegedly gained access to the companyโ€™s business records, including consumersโ€™ Social Security numbers and other PII.

Advance America data breach result of negligence, lawsuit says

Wilkinson alleges the Advance America data breach is a result of the companyโ€™s alleged failure to maintain a security system to adequately protect consumersโ€™ PII. He claims the loan company failed to take basic security measures, such as encrypting sensitive consumer information.

Wilkinson says he is concerned unencrypted PII may end up for sale on the dark web or fall into the hands of other unauthorized individuals.

โ€œDue to [Advance Americaโ€™s] negligence, cybercriminals obtained everything they need to commit identity theft and wreak havoc on the financial and personal lives of thousands of individuals,โ€ the Advance America data breach class action states.

Despite knowing about the data breach in February, Wilkinson claims the company failed to notify those affected until the middle of August.

He notes data breach victims are at an โ€œimmediate, imminent and heightened risk of all manners of identity theftโ€ and will likely have to spend time and money to mitigate the damage.

Wilkinson filed the Advance America class action lawsuit on behalf of himself and a proposed class of others whose PII may have been accessed in the Advance America data breach. There are other class actions in the works over the data breach, as well.

This isnโ€™t the first class action lawsuit Advance America has faced. In 2010, the company agreed to settle a class action lawsuit alleging it charged illegal fees and excessively high interest rates.

I did not hear of the class action in 2010 until I was notified on the recent security failures or I would of definitely included myself I have had two Identify Theft incidents, one with the IRS that took a year to resolve, cost me thousands and then again I get hit with false information and opening fraudulent accounts in my name. All the help everyone claims to provide consumers is just as fake as those who stole my identity. Please add my name to the list!

    1. Dean Jackson says:

I received a letter from advanced America informing me that my social security number was leaked in a data breach. They offered me a 1 year Kroll membership but it is not good enough for me. Somebody else filed my takes and received my 8,457 refund. There are multiple accounts recently opened and closed. Iโ€™m already a victim of identity theft and now even though I have been issued an IP pin for the past 8 years, u have to once again reobtain my own damn identity. This is ridiculous and to know they kept my info on file since 2008 is absolutely obscured and to have the audacity to offer me a simple credit monitoring for a yearโ€ฆ phhh.. it gets me sick. What makes it worse is I have no idea how to join this class action or even ha e the funds to do it. This is so heart breaking that I have had my life stolen once again and they think it is going to make me feel better about something this severe because they offered me a membership for a year. What about the years of damage I am now having to experience because their negligent actuons??
