A consumer hit Advance America Cash Advance Centers Inc. with a class action lawsuit in the wake of a data breach that allegedly exposed the Personal Identifiable Information (PII) of those who used the companyโ€™s loan services.

Advance America is a company that provides cash advances and other loan services in the United States.

Plaintiff John Wilkinson Advance America claims recently informed him of the data breach, which reportedly took place around Feb. 7. An unauthorized user allegedly gained access to the companyโ€™s business records, including consumersโ€™ Social Security numbers and other PII.

Advance America data breach result of negligence, lawsuit says

Wilkinson alleges the Advance America data breach is a result of the companyโ€™s alleged failure to maintain a security system to adequately protect consumersโ€™ PII. He claims the loan company failed to take basic security measures, such as encrypting sensitive consumer information.

Wilkinson says he is concerned unencrypted PII may end up for sale on the dark web or fall into the hands of other unauthorized individuals.

โ€œDue to [Advance Americaโ€™s] negligence, cybercriminals obtained everything they need to commit identity theft and wreak havoc on the financial and personal lives of thousands of individuals,โ€ the Advance America data breach class action states.

Despite knowing about the data breach in February, Wilkinson claims the company failed to notify those affected until the middle of August.

He notes data breach victims are at an โ€œimmediate, imminent and heightened risk of all manners of identity theftโ€ and will likely have to spend time and money to mitigate the damage.

Wilkinson filed the Advance America class action lawsuit on behalf of himself and a proposed class of others whose PII may have been accessed in the Advance America data breach. There are other class actions in the works over the data breach, as well.

This isnโ€™t the first class action lawsuit Advance America has faced. In 2010, the company agreed to settle a class action lawsuit alleging it charged illegal fees and excessively high interest rates.

    I have not received notice, and I know for a fact I should have. This company not only has had this data breach but steals information and refuses to be compliant with state and federal laws. They have been withholding my title from me and it was released through court approval. They are demanding more money from me and this is illegal. If any attorneys are available please add me to any future lawsuits regarding this piece of trash company.

    Please add me! I received a letter from Advance America saying there was a data breach and my information was part of the data accessed during the security breach. I had to close my bank accounts and open a new ones, get new debit cards etc. Itโ€™s been a nightmare ever since. I get notified of password changes that I didnโ€™t do, phone calls from scammers galore, almost daily, with ALL of my info. The one guy almost got me though, I have stage 4 cancer and I was sick so barely slept the night before. Otherwise I would have caught it instantly. He posed as someone through Google. Which I did contact Google the day prior about my purchases not going through. So it wasnโ€™t a red flag. He said I see here your having trouble with your account. I said yes, my purchasing issues. He said yes, I see that here and thatโ€™s why Iโ€™m calling. He said Iโ€™m gunna have you install an app so that I can see whatโ€™s going on on your screen so we can get this resolved. So I downloaded the app, canโ€™t remember the name of it. Then he says while itโ€™s installing Iโ€™m gunna go over your account info to make sure everything is current. He then proceeds to tell me my full name, DOB, home address, says my motherโ€™s and sisters full names and phone numbers and asks if those are correct. He had all the info! Then had me do something in the app which allowed him to mirror my screen or something. Then says I have here that your last 6 of your SSN is โ€ฆ. it was correct! Then says I just need you to verify the 1st 3 numbers so I know its really you. I said absolutely not! He got really agitated and said I canโ€™t move forward helping you without it. When I refused He got mad and started yelling at me. Telling me I was gunna lose my Google account and all the accounts attached to it, pictures etc if I didnโ€™t verify it. I said donโ€™t call me again. All types of calls on that same order from men and women. t

    I keep getting emails and I also have received 2 phone calls in which the caller knew my personal information. They stated that I owed them money & I better pay; I know 100% I do not. This seems to be because of a data breach; however I did not receive a letter. How do I join the lawsuit?

      I received a letter from my advanced America. They stated that my social security number and all of my personal information was leaked in a data breach. Someone has ultimately filed my taxes and caused $4,000 in IRS fees. They have stolen my identity, open bank accounts and completely disrupted my daily life

    I got a letter awhile back saying that they had a security breach and my information may have been stolen. I forgot who it was from so I donโ€™t know if it was them.

    I received an email and then harassing phone calls. The threats have gotten ridiculous. This needs to stop. I was not notified of a breach and the lady that keeps calling the threats and commentary are not only aggressive and threatening but need to stop. I should have been warned of a breach. This is horrible.
