Consumers whose personal information may have been violated in a 2019 Wichita State University data breach may be eligible to benefit from a class action settlement.

The Class is made up of anyone residing in the United States who was notified by Wichita State University in March 2020 of the data incident that occurred between Dec. 3 and, 2019. 

A class action lawsuit claimed Wichita State University was responsible for the 2019 data breach and formally accused the school of negligence, breach of implied contract, becoming unlawfully enriched, and violating Kansas consumer protection law.

During the cybersecurity incident, criminals may have gotten unauthorized access to some student and employee web portals, potentially exposing people’s names, email addresses, birthdates, Social Security numbers, and other data.

Under the terms of the settlement agreement, Class Members will be eligible to make two types of claims: expense reimbursement and lost-time reimbursement. 

Those who want to claim an expense reimbursement must provide related documentation along with their claim form.

Class Members may be reimbursed for out-of-pocket expenses in a number of categories, such as unreimbursed credit card charges, bank fees or penalties, overdraft fees or penalties, long-distance phone charges, costs of credit monitoring, and more.

Those wishing to claim a reimbursement for lost time must attest that any claimed lost time was spent dealing with the data breach incident and must provide a written description of how that lost time was spent.

Time spent dealing with issues related to the Wichita State University data breach will be calculated at a rate of $20 per hour, for up to three hours. These claims can only be made if at least one full hour was present dealing with issues related to the breach.

Class Members may file a claim for both types of payments. However, the maximum total amount any Class Member will be eligible for is $300.

Wichita State University has not been found guilty of any wrongdoing, and the Court has not ruled in favor of either party in this case.

A fairness hearing in the Wichita State University class action settlement is scheduled for July 27, 2021.

The deadline to object to or ask to be excluded from the settlement is June 10, 2021.

The deadline to file a claim is July 12, 2021.

Who’s Eligible
