Settlement reached over data breach. - Idaho Central Credit Union

Idaho Central Credit Union has agreed to a settlement to benefit consumers whose personal information may have been compromised during a 2020 data breach.

Included in the Class is anyone who received a notice from Idaho Central Credit Union that their personal information was or may have been compromised in the data breach initially disclosed by the credit union in or about February 2020, or who received a settlement notice stating they or their dependent(s) are Class Members.

Class Members may be able to recover up to $20,000 if they can prove their monetary loss was fairly traceable to the data breach.

Plaintiffs filed two separate class action lawsuits against Idaho Central Credit Union in February 2020 over two data breaches the credit union disclosed on or about Feb. 6, 2020, that potential compromised certain personal information of current and former customers. 

The plaintiffs claimed Idaho Central Credit Union did not do enough to protect the personal information.

The cases were later consolidated.

Idaho Central Credit Union is the state’s largest credit union, with more than 40 branches, according to BoiseDev. It controls more than $5 billion in assets.

The settlement agreement provides for several forms of relief for current and former Idaho Central Credit Union customers.

Under the terms of the settlement, Class Members will be able to make claims for ordinary losses and extraordinary losses.

Class Members will be eligible for a payment of up to $1,000 if they submit a claim and supporting documentation for out-of-pocket expenses related to the data breach, such as bank fees, data and cellphone charges, postage, fuel costs for local travel, and long-distance phone charges; for fees for credit reports, credit monitoring, or identity theft insurance products purchased between Feb. 1, 2020, and Jan. 19, 2021; and up to 40 hours of lost time, if at least one full hour was spent dealing with data breach-related issues, at a rate of $25 per hour.

Idaho Central Credit Union will provide up to $20,000 per Class Member on claims for extraordinary losses. 

These are proven monetary losses, including losses due to financial fraud or identity theft if the loss is an actual, documented, unreimbursed monetary loss; if the loss can be fairly traced to the data breach; if the loss is not already covered by one of the normal reimbursement categories; and if the Class Member made reasonable efforts to avoid or seek reimbursement for the loss.

Other losses or costs may be eligible as well, but all claims must be documented.

In addition to the monetary relief, Idaho Central Credit Union will offer Class Members 12 months of credit monitoring at no cost, regardless of whether they submit a claim for ordinary or extraordinary losses.

The credit monitoring will include daily monitoring by Experian, a $1 million identity theft insurance policy, and other features.

Class Members who already accepted Idaho Central Credit Union’s offer of credit monitoring will automatically receive an additional 12 months of monitoring. All other Class Members must opt in to the service by submitting a claim.

Idaho Central Credit Union also will update its data security business practices, including the implementation of multifactor authentication and increased training on cybersecurity for employees.

A fairness hearing will take place June 1, 2021.

The deadline to object to the Idaho Central Credit Union settlement has passed.

Anyone wishing to exclude themselves from the settlement must do so by April 19, 2021.

The deadline to file a claim is also April 19, 2021.

Who’s Eligible

Proof of Purchase
  • Claims for ordinary or extraordinary losses must be accompanied by supporting documentation.
  • For lost time, a sworn attestation detailing how the time was spent shall constitute supporting documentation.
