Creation Entertainment has agreed to a $950,000 settlement to benefit consumers who may have had their personal data compromised in a 2018 data breach.
All individuals residing in the United States who used a debit or credit card to make a purchase from Creation Entertainment and whose personal Information was accessed and/or compromised by unauthorized individuals as part of the security incident are part of the Class.
Each Class Member is eligible for a basic payment of up to $200 regardless of whether they had any unauthorized charges on their card.
A class action lawsuit had sought to hold Creation Entertainment accountable for a data breach that occurred between Feb. 1, 2018, and Oct. 10, 2018, and publicly disclosed in March 2019.
Creation Entertainment maintains it did nothing wrong but has agreed to a settlement in order to avoid the expense and risk involved in continuing litigation. A court has not ruled in either party’s favor.
Creation Entertainment produces fan conventions for TV and movie franchises such as Star Trek, The X-Files, Star Wars, Supernatural, Dr. Who, and many more.
Class Members submitting valid claim forms and supporting documentation may be eligible to receive either a Basic Settlement Payment or an Extraordinary Reimbursement Settlement Payment.
Each Class Member is eligible for a Basic Settlement Payment of up to $200 regardless of whether the card used to make the Creation Entertainment purchase was hit with any fraudulent charges.
Anyone seeking a Basic Settlement Payment must provide the documentation and information required on the claim form.
Alternatively, Class Members may seek an Extraordinary Reimbursement Settlement Payment of up to $10,000 if they experienced unauthorized charges on their card between Feb. 1, 2018, and April 19, 2019, that were not denied or reimbursed, and which the Class Member believes in good faith were likely caused by the Creation Entertainment data breach.
Extraordinary Reimbursement Settlement Payment claims cover up to three hours (at a rate of $20 per hour) of lost time spent dealing with unauthorized charges, as well as related out-of-pocket expenses, such as:
- Unreimbursed payment card fees or unreimbursed bank fees — such as card re-issuance fees, overdraft fees, late fees, etc. — incurred as a result of the security incident
- Cellphone, internet, or text charges related to the breach
- Costs or charges for obtaining credit reports or credit freezes as a result of the breach
- Postage costs incurred as a result of the security incident
However, before submitting such a claim, claimants must have exhausted all available credit monitoring and identity theft insurance.
Final payment amounts may be adjusted depending on how many valid claims are filed.
Each Class Member is entitled to submit only one claim per credit or debit card used to make a Creation Entertainment purchase.
A final approval hearing is scheduled for June 24, 2021.
The deadline to opt out of or object to the Creation Entertainment settlement is May 24, 2021.
The deadline to file a claim form is June 22, 2021.
