Ferndale Property Management and other related companies agreed to pay $135,000 to resolve claims they violated Illinois biometric laws with fingerprint time clocks.

The settlement benefits individuals who used a fingerprint-scanning time clock at any of Ferndale’s facilities in Illinois between Aug. 11, 2016, and Dec. 29, 2022, before signing a consent form regarding biometric privacy.

Plaintiffs in the biometric privacy class action lawsuit claim that Ferndale Property Management, Autumn Ridge Apartments and other related companies violated their rights by collecting and storing their fingerprints through biometric time clocks. 

According to the class action, the defendants failed to comply with Illinois’ Biometric Information Privacy Act (BIPA) when storing biometrics and providing information disclosures.

Ferndale Realty is a property investment company that owns apartment buildings around the country.

The defendants haven’t admitted any wrongdoing but agreed to resolve these allegations with a $135,000 class action settlement.

Under the terms of the settlement, class members can collect an equal share of the net settlement fund. 

According to the settlement website, each class member is projected to receive between $500 and $600. However, exact payments will vary depending on the number of participating class members.

The defendants also agreed to stop using any scanning or biometric time clocks at their facilities. The companies will comply with BIPA regarding retention and destruction of previously recorded biometric data.

The deadline for exclusion and objection is Feb. 13, 2023.

The final approval hearing for the settlement is scheduled for April 11, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement payments.
