Travelers who purchased parking at Fort Lauderdale-Hollywood International Airport between certain dates in 2018 and 2019 may be eligible to benefit from a $1.1 million class action settlement resolving claims the parking receipts violated the federal Fair and Accurate Credit Transactions Act (FACTA).

The Class is made up of anyone in the United States who purchased parking from Broward County at Fort Lauderdale-Hollywood International Airport at any time between June 28 and Oct. 31, 2018, or between April 5 and 22, 2019, and who paid by using a personal debit or credit card (not a business debit or credit card) at a location that printed customer parking receipts that contained the expiration date or more than the last five digits of the debit or credit card number.

A class action lawsuit accused defendants SP Plus Corp., Hub Parking Technology USA Inc., and Broward County, Florida, of violating FACTA by printing certain digits or expiration dates at some parking locations at the Fort Lauderdale airport between certain dates.

The defendants deny any wrongdoing or liability. However, both parties have agreed to a settlement in the case. The Court has not ruled in either side’s favor.

More than 10.5 million passengers passed through Fort Lauderdale-Hollywood International Airport between January and May 2021, according to statistics on the Broward County website.

Qualifying Class Members who file a valid claim form will receive a payment of $50.

Class Members do not have to provide copies of their parking receipts in order to be eligible to participate in the FACTA settlement, but they must provide the date they parked at the Fort Lauderdale airport, the location where they parked, and certain cardholder information related to the card used to pay for parking.

Payments will be mailed after the Court grants the settlement final approval.

A final fairness hearing in the Fort Lauderdale-Hollywood International Airport FACTA settlement is scheduled for Oct. 7, 2021.

Those who wish to exclude themselves from the settlement must do so by Sept. 1, 2021; objections are due by Aug. 17, 2021.

Claims must be filed by Nov. 8, 2021.
