Yaz Injury Lawsuit Filed Jointly by Two Women

By Andrea Gressman

Yaz injury lawsuitTwo additional Yaz injury lawsuits have been added to the growing number of birth control lawsuits against the manufacturers of Yaz, Yasmin, Ocella, and Beyaz for the very serious and potentially life threatening side effects they have been repeatedly linked to. Tennessee resident Anita Goodwin and New York Resident Tiffany Robinson joined together to file their Yaz injury lawsuit in the State of California’s Superior Court in Los Angeles County on October 5, 2012

These two plaintiffs have filed their Yaz birth control lawsuits together and are claiming that the complications they experienced occurred directly from taking Yaz. Bayer Healthcare Pharmaceuticals, Inc., Bayer Corporation, Bayer Healthcare, LLC, Barr Laboratories, Inc., Bayer Schering Pharma AG, McKesson Corporation, NS, and Teva Pharmaceuticals USA, Inc., were all named as the defendants. Several counts of negligence have been filed against the Yaz, Yasmin, and Ocella manufacturers, including:

* Negligence
* Failure to warn
* Manufacturing defect
* Fraud
* Strict products liability
* Breach of express and implied warranties
* Violation of business and professions codes

The two plaintiffs seek financial damages in the form of compensatory, punitive, treble, as well as others.

Just like many of the other Yaz, Yasmin, Ocella, and Beyaz lawsuits, the plaintiffs in this Yaz injury lawsuit are claiming that they experienced significant injuries as a direct result of taking Yaz, their chose form of birth control.

Yaz, Yasmin, and Ocella Studies Link Drospirenone Birth Control to Elevated Risks of Blood Clots

Yasmin is the predecessor of Yaz and Ocella is the generic form of Yasmin and they do contain the 4th generation progestin, drospirenone. As of April of 2012, the FDA required that the Yaz warning label be updated to include the following statement: “some epidemiologic studies reported as high as a three-fold increase in the risk of blood clots for drospirenone-containing products.”

The elevated side effect risk of blood clots in Yaz, Yasmin, Ocella and Beyaz is believed to happen because of the reaction between drospirenone and the synthetic estrogen hormone ethinyl estradiol. These are the main ingredients in Yasmin, Yaz, Beyaz and Ocella. It is believed that the drospirenone does not properly counteract the blood clotting effect that estrogen has. Therefore, when patients use Yaz, Yasmin, and Ocella their blood clot side effect risk is elevated and their risk of additional side effects is increased as well. These side effects include:

* Stroke
* Deep vein thrombosis
* Pulmonary embolism
* Other life-threatening complications

There have been so many Yaz, Yasmin, Ocella, and Beyaz lawsuits filed that one option the court system has available to victims of birth control blood clots is the option of joining a Yasmin/Yaz lawsuit MDL. These multidistrict litigations (MDL’s) were established in order to handle the growing number of Yaz, Yasmin, Ocella, and Beyaz lawsuits.

One particular Yaz lawsuit MDL formed in the Southern District of Illinois and overseen by the Honorable Judge David R. Herndon now has more than 6,600 Yaz/Yasmin lawsuits in it, all claiming that the birth control caused significant complications.

It has been reported that Bayer has already paid out over $402 million in Yaz, Yasmin, and Ocella settlements and that there is another $610.5 million set aside to handle additional Yaz, Yasmin, and Ocella lawsuit settlements. However, some industry analysts, like JP Morgan Chase’s Richard Vosser, feel that by the time the Yaz, Yasmin, and Ocella lawsuits are all said and done that Beyer will have had to pay out $2.5 billion.
