Yasmin/Yaz Lawsuit News: Motion Denied by MDL Plaintiff Attorneys

A motion made by Yaz lawyers in the Yasmin/Yaz lawsuit multidistrict litigation (MDL) asking the court to force Bayer to release 330 documents that had previously been withheld was denied by the presiding Judge David R. Herndon. The ruling in favor of Bayer is not seen as a major setback for Plaintiffs with Yaz lawsuits pending in the MDL. Bayer has already agreed to pay $142 million in Yaz lawsuit settlements to resolve claims it did not adequately warn women about the serous risks of side effects, including blood clots, pulmonary embolism, deep vein thrombosis, and more.
The Yaz lawsuit MDL lawyers wanted Bayer to hand over hundreds of documents it was withholding in the litigation, but Bayer asserted the documents in question were protected by attorney client privilege. Judge Herndon agreed with Bayer on almost all counts and denied the majority of the motion brought by the Yasmin lawyers on the Plaintiffs’ behalf. Bayer has already turned over more than 3.5 million documents to Yaz lawsuit attorneys during the discovery process of the Yaz lawsuit MDL, which helped secure millions of dollars in Yaz lawsuit settlements so far. Despite reaching settlement agreements in some of the cases, women are still able to sue Bayer for their Yaz blood clot injuries and have their lawsuits join the Yasmin/Yaz lawsuit MDL. Thousands of Yaz blood clot lawsuits pending in the MDL are still awaiting resolution.
