Wrongful Death Lawsuit Filed Over Baby’s Death from Zoloft Birth Defects

Another Zoloft lawsuit has been added to the growing number of birth defect cases filed against Pfizer. However, this one was actually filed as a Zoloft wrongful death lawsuit. The lawsuit was filed on October 24, 2012 by a couple who resides in Maine. It was filed in the United States District Court of the Eastern District of Pennsylvania in Philadelphia and has joined the current multidistrict litigation (MDL) that has been established for Zoloft lawsuits. The lawsuit claims the couple’s baby girl, born in December 2010, died shortly after her birth due to complications caused by Zoloft birth defects. As a result, they have filed a wrongful death lawsuit and are seeking compensation for their loss.
The Zoloft lawsuit goes on to explain that the mother took the SSRI drug during her pregnancy in order to treat her depression. However, the plaintiffs state that Pfizer, the manufacturer of the popular antidepressant, did not properly warn the medical community, patients, or the general public about the potential side effects Zoloft has on the fetus when the mother takes Zoloft during pregnancy.
The Zoloft lawsuit claims that Pfizer was completely aware of the pregnancy side effect risk associated with their drug but did not complete the necessary changes to the Zoloft label, nor did they conduct any consumer warnings regarding the side effect risk as well. The birth defect lawsuit states that by not providing an adequate warning they have put thousands of children at risk for developing birth defects caused by Zoloft.
There was a study published in the British Journal of Medicine just a year before this couple had their child stating that women who used Zoloft in their first trimester of pregnancy were twice as likely to have a child with an atrial septal defect as those who did not. It was stated in this lawsuit that Pfizer did not provide this information as well as other information they had linking Zoloft to different birth defects with Zoloft patients in order to maintain their profits
As mentioned above, this Zoloft lawsuit has been consolidated with a number of other Zoloft birth defect lawsuits to a MDL in Pennsylvania. It is referred to as In Re: Zoloft (Sertraline Hydrochloride) Products Liability Litigation MDL 2342 and is being presided over by the Honorable Cynthia M. Rufe.
Zoloft has been linked to a number of very serious side effects if used during pregnancy, including the following:
- Craniosynostosis
- Heart defects
- Persistent pulmonary hypertension of the newborn (PPHN)
