Woman Alleges NuvaRing Caused Deep Vein Thrombosis (DVT)

NuvaRing side effects, deep vein thrombosis, DVTNuvaRing birth control became a popular choice for contraception when it first hit the U.S. market. Despite its popularity, some women are reporting the vaginal ring caused them to develop serious blood clotting problems, including deep vein thrombosis (DVT). Many of these women have decided to sue the manufacturer for failure to warn, negligence and defective product design.
 
The latest woman to sue NuvaRing manufacturer Organon USA is Magdalena Szopa, who filed her NuvaRing lawsuit on Oct. 23, 2013, three years after she experienced DVT. Like other women, she thought NuvaRing sounded safe and easy. NuvaRing is a plastic ring that’s inserted vaginally and releases small amounts of hormones. It’s removed every three weeks and left out for one week to allow for a menstrual cycle, then replaced with a new ring. Unlike birth control pills, women don’t have to remember to do anything daily. Instead, the NuvaRing requires just a once per month commitment. 

According to Szopa’s NuvaRing lawsuit, the manufacturer “failed to properly disclose the known safety hazards associated with NuvaRing. The package insert accompanying NuvaRing stated that the vaginal ring is expected to be associated with similar risks to that of birth control pills and that the safety information they provide to consumers is derived primarily from studies of birth control pills. Therefore, the safety information provided to the consumer was not derived primarily from studies of NuvaRing and, therefore, the package insert accompanying NuvaRing is misleading.”
 
NuvaRing blood clot victims claim that, instead of taking responsibility and warning people about NuvaRing risks, the buck was passed onto consumers and the medical community. Different birth control pills have different risks, so a blanket statement comparing NuvaRing to “birth control pills” isn’t appropriate, they allege.

In her NuvaRing lawsuit, Szopa says that the companies “failed to warn of the extent of the risk of stroke, venous thromboembolism, including Superficial Venous Thrombosis (SVT), Deep Vein Thrombosis (DVT) and Pulmonary Embolism (PE), stroke, and death associated with use of the novel combined contraceptive vaginal route of administration, NuvaRing.”
 
She says she wasn’t given a choice to decide if the risks of NuvaRing were worth the benefit. Because she didn’t know she was at risk for these conditions, she couldn’t watch for them. Sometimes blood clots have virtually no symptoms, but catching them in time is crucial. Szopa says that had she known about the risks associated with NuvaRing side effects, she would have selected a different form of contraception. 

Szopa is suing the companies for defective manufacturing, defective design, defect due to inadequate warning, breach of warranty, negligence, misrepresentation/fraud, and violation of Illinois consumer protection statutes. 

The NuvaRing lawsuit is Magdalena Szopa v. Organon USA Inc., et al., Case No. 0:13-cv-02918-JNE-JJK, in the U.S. District Court for the District of Minnesota.
