West Virginia opioid litigation settlement, funds prediction overview:ย 

  • Who: West Virginia Attorney General Patrick Morrisey predicted the state will ultimately receive $1 billion in funds from opioid litigation class action settlements.ย 
  • Why: Morrisey made his predictions during a news conference discussing settlements with the state made by CVS and Walmart that are worth $82.5 million and $65.1 million, respectively.ย 
  • Where: The news conference occurred in West Virginia.

The attorney general of West Virginia speculated that the state will ultimately receive $1 billion dollars from opioid settlements made to resolve claims against companies accused of exacerbating the West Virginia opioid epidemic.ย 

Attorney General Patrick Morrisey made the prediction amidst opioid settlement agreements worth nearly $150 million combined being signed by CVS Pharmacy and Walmart, Law360 reports.ย 

Morrisey reportedly made his prediction during a news conference conducted to discuss Walmart and CVS opioid litigation settlements.

CVS and Walmart will pay $82.5 million and $65.1 million to the state, respectively, with Morrisey pointing out that the sums bring the total amount of funds given to West Virginia to around $875 million, Law 360 reports.ย

Morrisey reportedly cited ongoing litigation against pharmacies run by The Kroger Co. and Walgreens, in addition to potential recoveries from drug companies that went bankrupt, as evidence that a 10-figure amount would be reached.ย 

West Virginiaโ€™s attorney general has reportedly been critical of opioid litigation settlements reached by other states with drug companies, arguing the compensation amounts are too dependent on population size, Law360 reports.

Morissey reportedly said he believes that the amount of the West Virginia opioid settlement should be determined by the amount of overdose deaths โ€” with West Virginia reportedly averaging 70 opioid deaths per 100,000 residents in 2020.ย 

In July, a federal judge ruled that three major drug distributors were not liable for exacerbating the opioid epidemic in Cabell County and the city of Huntington, West Virginia.ย 

The judge overseeing the complaint determined that Cabell County and the city of Huntington had failed to prove that drug distributors McKesson, Cardinal Health and AmerisourceBergen had broken the law by the way they distributed drugs.ย

    I agree with Jamie.Heck,I would be satisfied if the Dr. Fees and the narcotic Rx,s that were paid for them for years,were refunded to me with interest .We the people that paid to get them at least,need all the money back.we can prove we took them,and suffered nightly and didnโ€™t know what we got into.I hope a brilliant lawyer will help me.I also predict,is addicts,that made the opoid Companyโ€™s rich,will not get anything from this billion.

    The money should be going to the addicts. They are the ones who are suffering and will always be fighting that demon itโ€™s ridiculous that the state makes money on the suffering of others they didnโ€™t lose loved ones or go through the sickness, jail prison or have a felony convection. The addicts pay with there life and the government and stateโ€™s profit off of it. Itโ€™s wrong Iโ€™ve spent hundreds of thousands of my hard earned money to fight my addiction and Iโ€™m still paying for it whereโ€™s my money? My doctor told me the opioids they were prescribing weโ€™re not addictive and come to find out itโ€™s ruined the rest of my life. I have to fight my addiction every day of my life and no one else is paying for the hell ive went though except me!

    I wish I could be added Iโ€™d we the people can be Iโ€™m from WV wayne Co right beside Cabell Co and Iโ€™ve been sober since 2014 but I too was victim to the drugs in wv and Mt life was ruined I wish that Fed Judge would hear me out
