Pfizer Chantix Class Action Lawsuit Overview:

  • Who: A class action lawsuit filed against drug maker Pfizer Inc. over its stop-smoking drug Pfizer has been dismissed.
  • Why: In the aftermath of a recall, the plaintiff said she and other Chantix users were exposed to dangerously high levels of a type of carcinogen that Pfizer should have disclosed.
  • Where: The case was dismissed in New York federal court.

Pfizer did not have a duty to disclose that its recalled stop-smoking drug Chantix was contaminated by a type of carcinogen, or that it was unfit to help consumers quit smoking, a New York judge has ruled.

In an order published Feb. 16 in a Manhattan federal court, Judge Denise Cote dismissed the class action lawsuit filed against Pfizer, Inc by consumers of the anti-smoking drug, Reuters reports.

In her decision, Judge Cote said the plaintiffs had brought no plausible allegations that Pfizer had a duty to tell consumers Chantix was contaminated by a carcinogen known as nitrosamine and no proof that Pfizer’s labels were misleading.

She said, because Pfizer had offered full rebates for unused Chantix, the damages to consumers were only for tablets that the plaintiffs consumed. 

“We continue to stand behind the safety and efficacy of Chantix, which has helped millions of Americans quit cigarette smoking,” Pfizer said in a statement.

The original class action, filed August 2021, was brought by lead plaintiff Roslyn Harris on behalf of herself and other Chantix users who were affected by a recall of 12 lots of the stop-smoking drug issued by Pfizer this summer

Harris accused the drug maker of misrepresenting the safety of the product to consumers by failing to properly test Chantix for the “carcinogenic impurity” despite warnings from regulators.  

She alleged she and other Chantix users would not have purchased the medication had they known it contained a cancer-causing impurity.

    I got deathly sick when I took it amd walmart sent a recall out after I used 4 boxes.

    took for one month went to hospital with renal shut down have not been the same since.

    I received two letters from them for this and I even complained to my Dr how sick I was getting when I was taking it and went off it. I didn’t have the same issues before when I took it only this time and I had taken the pills for two months before stopping this time trying to get through it
