Unum Claim Denial Lawsuits Underway

Several lawsuits have been brought against Unum for steadily denying disability insurance claims over the past two decades. Formerly known as either Unum Provident as well as First Unum, the insurance company and its subsidiaries, which include The Paul Revere Life Insurance Company, Colonial Life & Accident Insurance Company and Provident Life, have been accused of illegally denying valid disability claim payouts.
Unum is the largest disability insurance provider in the U.S., providing insurance policies to over 17 million Americans. Lawsuits against the company include personal injury cases alleging bad faith insurance practices and long-term disability denials.
Unum Feeling the Pressure from the Department of Labor
With pressure and the threat of investigation into the company’s practices by the Department of Labor, Unum offered to reassess close to 200,000 claims that were denied or closed since January 1, 2000. Any claims that were denied or closed for any reason other than death, reaching the maximum benefits or settlement would be looked into. Insurance claims between January 1, 1997 and December 31, 2006 were also ordered to be reassessed.
Services Unum is expected to Provide
Unum is an insurance company that offers individual and group insurance programs to the public. With more than 25 million insured clients, Unum offers benefits such as life insurance, long-term disability income protection, and long-term care insurance (LTCI), voluntary critical illness insurance and short-term disability income protection. The insurance claims under investigation involve disability income protection, which is meant to provide financial benefits to employees with disabilities caused by illness or injury and are as such unable to work. These benefits are to be given whether the disability is directly related to their work or not.
Denial Tactics Used by Unum
Unum claim denial lawsuits have named several denial tactics the insurance company has used to avoid paying out their policies. Tactics have included:
* Taking unqualified opinions from supposed experts and inadequately investigating the claim
* Medical records being misread by Unum’s independent medical examiners
* Changing a policy after claim has been filed
* Contending that the condition is pre-existing
* Only issuing partial payments for total disability
* Employing friends, detectives, neighbors and co-workers to spy on the claimant to discredit their claim
* Refusing to recognize disabilities such as chronic fatigue syndrome, mental disorders and fibromyalgia
These are just a few of the many denial tactics Unum has been known to use in order to refuse insurance claims.
