Two Women File Yaz DVT Lawsuit in California

Jessica Carlton and Tara McLaney of California have joined dozens of other women who have filed Yasmin/Yaz injury lawsuits against Bayer. Along with the generic versions Ocella and Beyaz, these oral contraceptives can cause serious side effects — as Carlton and McLaney discovered too late. The women filed their lawsuit in early April 2013 in California, where other Yaz and Yasmin lawsuits have been consolidated. Carlton is from Georgia and McLaney from Alabama.
Deep vein thrombosis (DVT) is the most common severe side effect of Yaz, and it can sometimes be fatal. Both women were prescribed Yasmin and followed the directions given by their doctor. Oral contraception like Yaz and Yasmin is one of the most popular forms of birth control in the U.S. However, both women developed DVT. While both women survived, they allege that the Bayer purposefully marketed the product as safe when it carried big risks.
The Seriousness of Yaz DVT
At the most basic level, DVT is a blood clot. However, clots can travel throughout the body — such as to the lungs — and cause a pulmonary embolism. This is a life-threatening condition, and sometimes there are few warning signs. If a blood clot is in the legs, there might be bruising, swelling or pain, but those are all also symptoms of a harmless bruise that can easily go unnoticed.
When it comes to DVT, some patients experience a feeling dizziness, being short of breath, an irregular heartbeat, chest pain or coughing. Of course, these are also relatively minor Yasmin DVT symptoms. Oftentimes, a life-threatening DVT diagnosis is overlooked, especially in healthy women who are taking one of the most common forms of contraception.
Bayer Has Paid Nearly $1 Billion in Lawsuit Settlements
Fourth-generation Yaz and Yasmin, which Carlton and McLaney were prescribed, have been strongly linked to an increase in deep vein thrombosis. Thus far, Bayer has paid out $1 billion in Yasmin lawsuit settlements. In addition, lesser but still viable Yaz-related side effects include blindness, breast cancer, heart attacks, strokes and cancer.
In a recent four-year period, the FDA has received 50 complaints that Yasmin caused death. It’s important to bear in mind that some victims are very young, as high schoolers often start a birth control regimen with oral contraception. According to Carlton, McLaney and other victims, Bayer purposefully hid the risks of Yaz and it continues to be a fairly commonly prescribed form of birth control.
