Texas Woman Severely Injured by Yaz Files Lawsuit

Yaz injury lawsuitAndrea Neloms thought she’d found the perfect oral contraception when she started taking Yaz, but she did not know that the birth control pill can cause deep vein thrombosis (DVT), blood clots, pulmonary embolism, and even death in some cases. She is now suing Bayer, the maker of Yaz birth control, for failure to warn and negligence, saying she suffered “severe physical and personal injuries from taking both Yaz and the generic Yaz brand, Ocella.

In a lawsuit filed August 1, 2013, Neloms says that “during the brief time that Yaz and Yasmin have been sold in the United States, hundreds of reports of injury and death have been submitted to the FDA in association” with Bayer’s birth control products. Medical reports on the dangers of Yaz and Yasmin began to be published in 2002, and during a short five-year period following that report, there were over 50 reports of death among users of Yaz and Yasmin filed with the FDA.

“Some deaths reported occurred in women as young as 17 years old,” Neloms’ Yaz lawsuit states. The deaths tallied include “deaths associated with cardiac arrhythmia, cardiac arrest, intracardiac thrombus, pulmonary embolism, and stroke in women in their child bearing years.” 

However, Yaz victims like Neloms say they were never warned about the real risks of Yaz side effects because there weren’t appropriate warnings on the packaging. According to the Yaz lawsuit:

“Two recent studies, released in August 2009, have found significantly increased risks of harm associated with Yaz/Yasmin over other types of birth control pills. The first study assessed the risk of developing venous thrombosis in women who use oral contraception. The women ranged in age from 15 to 49 and had no history of heart disease or any malignant condition. The study found that of the 3.3 million women taking oral contraceptives, there were 4,213 venous thrombotic events. Of this total, 2,045 occurred in women using drospirenone oral contraceptives. The study concluded that ‘oral contraceptives with . . . drospirenone were associated with a significantly higher risk of venous thrombosis than oral contraceptives with evonogesterel’.” 

Neloms claims that Yaz was over-promoted and that she, and other women like her, were under-warned. 

“Despite the wealth of scientific evidence, Defendants have not only ignored the increased risk of the development of the aforementioned injuries associated with the use of Yaz/Yasmin, but they have, through their marketing and advertising campaigns, urged women to use Yaz/Yasmin instead of birth control pills that present a safer alternative,” the Yaz lawsuit says.

Fortunately, Neloms survived her Yaz blood clot experience. However, “as a direct and proximate result of her use of Yaz/Yasmin, Plaintiff suffered physical injury, including but not limited to, conscious pain and suffering, as a result of her severe physical and personal injuries.” 

Had she known about the risks of Yaz and Ocella side effects, she never would have taken the birth control pills, her lawsuit says.

Neloms is suing Bayer for defective manufacturing, design defect, defect due to inadequate warning, negligence, fraud, breach of warranty, violation of the deceptive trade practices act, intentional and wanton conduct and request for punitive damages. 

She’s seeking compensatory damages, medical expenses and other economic damages, punitive damages, attorney’s fees and any other relief the court sees as appropriate.

The case is Andrea Neloms v. Bayer Corporation, et al., Case No. 13-cv-10781. It has joined the Yasmin/Yaz blood clot MDL known as In Re: Yasmin And Yaz (Drospirenone) Marketing, Sales Practices And Relevant Products Liability Litigation, MDL No. 2100, in the U.S. Court Southern District of Illinois.
