The settlement benefits a 2021 class of candidates who took the NAPLEX test administered by the National Association of Boards of Pharmacy between Aug. 31 and Sept. 8, 2021, who received a Sept. 17, 2021, notice that their NAPLEX score was incorrectly reported as “failed” when they had actually passed the test. The settlement also benefits a 2022 class of candidates who took the NAPLEX test administered by the NABP between July 30 and Oct. 26, 2022, who received a Nov. 8, 2021, notice that their NAPLEX score was incorrectly reported.

National Association of Boards of Pharmacy class action lawsuit overview: 

  • Who: Emily Glaspie filed a class action lawsuit against the National Association of Boards of Pharmacy (NABP). 
  • Why: Glaspie claims the NABP harmed her and other pharmacist candidates by wrongly reporting that they failed their North American Pharmacist Licensure Examination. 
  • Where: The class action lawsuit was filed in Illinois federal court. 

The National Association of Boards of Pharmacy (NABP) wrongly reported that pharmacist candidates failed their North American Pharmacist Licensure Examination (NAPLEX), a new class action lawsuit alleges. 

Plaintiff Emily Glaspie claims the NABP wrongly reported that she and “hundreds of others” had “failed the NAPLEX, when they had not.” 

Glaspie argues the NABP—which she says develops, implements, and administers the NAPLEX—scored the allegedly wrongly failed tests incorrectly, causing “trauma and distress” and “demotions or even a rescinded job offers or residencies.” 

“Because of Defendant’s negligence in scoring and producing the NAPLEX, Plaintiff—along with hundreds of others—were subject to the embarrassment, stress, pressure, and negative connotations associated with failing the exam,” states the NAPLEX class action. 

NABP accused of being aware of incorrect scoring issue due to prior errors

The NABP, meanwhile, was aware that there were issues with the scoring for the NAPLEX, arguing “the exact same thing happened to over 400 students in 2021,” the NABP class action alleges. 

Glaspie wants to represent a nationwide class of individuals who took the NAPLEX test administered by NABP between Aug. 31, 2021 and Sept. 8, 2021, and July 30, 2022 and Oct. 26, 2022 who received notice that their score had been incorrectly calculated. 

The NABP is accused of negligent misrepresentation, defamation per se, negligence, and breach of contract, and of violating the Illinois Consumer Fraud and Deceptive Business Practices Act

Plaintiff is demanding a jury trial and is requesting an award of actual damages for herself and all class members. 

In July of last year, a California federal judge gave the final okay for a $10.4 million class action settlement made to resolve claims CVS Pharmacy had failed to pay their pharmacists overtime wages.
