Pfizer Faces New Lipitor Lawsuit over Diabetes Claims
By Shawn Coates
Louisiana plaintiff Dana Birden has filed a lawsuit against drug manufacturer Pfizer Inc. because of dangerous side effects allegedly caused by its popular drug Lipitor. Ms. Birden alleges that as a direct result of consuming Lipitor, she developed type-2 diabetes. As a result, she must manage her blood glucose levels, stick to a strict diabetic diet and take specific medication for her diabetes.
From Jan. 2007 until Feb. 2010, Birden was prescribed and took Lipitor because she believed the drug would significantly lower her risk of developing heart disease. She allegedly relied on clinical test information directly from Pfizer stating the safety and intended outcomes of their product, which indicated the drug was safe to take.
History of Lipitor
After being approved by the U.S. Food & Drug Administration (FDA) in 1996, Pfizer began to distribute and sell Lipitor on the market in early 1997. The FDA approved Lipitor to reduce the amount of cholesterol and other fatty substances in the blood. While Lipitor lived up to its reputation of reducing the amount of cholesterol in a person’s blood, studies have shown that Lipitor can be causally related to type-2 diabetes. It is alleged that Pfizer even had prior knowledge of the risks associated with their product, Lipitor, but continued to sell their product anyways.
According to the Lipitor lawsuit, the FDA even sent a notice to defendant Pfizer in 2012, asking the drug maker to make labeling changes based upon clinical trial data. Pfizer responded to this notice by updating the Lipitor label with this warning: “Increases in HbA1c and fasting serum glucose levels have been reported with HMG-CoA reductase inhibitors, including LIPITOR.” Pfizer reportedly believes that this label is sufficient but attorneys say otherwise. According to many Lipitor lawsuits, this label fails to properly inform the consumer that their risk of developing type-2 diabetes is increased when taking Lipitor. If there had been a sufficient label explicitly stating an increasing risk of developing diabetes, then plaintiff Birden allegedly would have never taken Lipitor in the first place, thus possibly avoiding her current dismay.
The Lipitor lawsuit is Dana Birden v. Pfizer Inc., Case No. 2:13-cv-06074-SSV-SS, in the U.S. District Court for the Eastern District of Louisiana.
