Painful Vaginal Mesh Implant Complications Lead to Lawsuits

Vaginal mesh implant surgeries are performed routinely each year to help repair transvaginal conditions such as pelvic organ prolapse (POP) or urinary incontinence. Among these surgeries, there are thousands who will go on to experience vaginal mesh side effects that leave them in agony and some are even required to undergo additional surgeries to help repair the damage done by the initial vaginal mesh implant. As a result of these painful vaginal mesh side effects, thousands of women have elected to file vaginal sling implant lawsuits against several manufacturers, including American Medical Systems (AMS), Boston Scientific, Ethicon, Coloplast and C.R. Bard.
Vaginal Mesh Side Effects Cause Pain
There are several different types of complaints as to the failure of vaginal mesh implants, but each of them includes the complaint of experiencing pain after the implant is inserted. Among the chief complaints filed in transvaginal mesh implant lawsuits:
- Ongoing pain, especially during intercourse
- Erosion of vaginal mesh through the vaginal walls
- Shrinking of the vaginal mesh
- Perforation of organs, after migration of vaginal mesh
Many women who have experienced any of these complications have found themselves facing the necessity of having repeat surgeries, further increasing their risk.
Vaginal Mesh Implant Lawsuits Consolidated
Thousands of transvaginal mesh lawsuits have been filed against the manufacturers of the implant. In an effort to make the lawsuits run smoother, several of the pending actions have been consolidated. The most recent vaginal mesh implant lawsuit consolidation is combining several manufacturers – five, to be exact – together under the jurisdiction of the Southern District of West Virginia. This is not to say that the vaginal mesh lawsuits will be heard together, only that pretrial processes for the lawsuits will be held at the same time. The vaginal mesh implant lawsuits will be considered on an individual basis depending on the individual claims that are being made.
This is not a class action lawsuit, but rather a multidistrict litigation, which is handled differently. Individual awards of compensation are available in MDL lawsuits whereas class action lawsuits result in a lump sum award that is shared by the members of the class.
There is no set date for the vaginal sling implant lawsuits to begin trial individually, but the court has already established certain dates in December of 2013 for bellwether trials to take place. Bellwether trials are a way for both parties – the plaintiff and defendant – to determine how the jury will regard the evidence that is presented by both sides. Bellwether trials are useful in that they help the defendant to make an educated decision on whether to settle the case or proceed with the vaginal mesh injury lawsuits in hopes of having the claims dismissed or a lesser compensation awarded.
