New Lipitor Diabetes Lawsuit Filed by California Woman

California resident Aubrey Isom alleges in a new lawsuit against Pfizer Inc. that its prescription cholesterol drug, Lipitor, caused her develop type-2 diabetes. The Lipitor diabetes lawsuit was filed August 15, 2013.
Isom alleges in the Lipitor lawsuit that she began taking the medication in 2006 to lower her low-density lipoprotein, or LDL cholesterol, as part of an overall plan to reduce her risk for cardiovascular disease. She was diagnosed with type-2 diabetes about a year later – a side effect of Lipitor that neither she nor her doctor was aware of, according to the lawsuit.
Isom claims Pfizer should have known about the risk of Lipitor diabetes since it was patented and marketed in 2000. It was not until February 2012 that the company complied with a label change mandate from the FDA to update the warning for Lipitor side effects to include diabetes, although the lawsuit notes that it did so “in the most obtuse terms [regarding] a potential elevation of blood sugar.”
The lack of a clear indication of the risks of Lipitor type-2 diabetes side effects led Isom to claim a count of failure to warn in her lawsuit. She also alleges that studies should have been completed before the release of Lipitor on the market which would have warned patients and their doctors that the popular statin medication carried significant risks regarding the elevation of blood sugar.
The Lipitor lawsuit states that “Lipitor has been implicated in a national epidemic of type 2 diabetes in women taking” the cholesterol drug. As a result, counts against Pfizer include negligence, failure to warn, breach of implied and express warranties, deceit and fraud by concealment, negligent misrepresentation and several state statute violations.
