Mississippi Woman Says Lipitor Caused Her Diabetes

Plaintiff Ruby Miller says in a new Lipitor lawsuit filed August 29, 2013, that she faced elevated blood sugar levels and developed type-2 diabetes as a result of undisclosed Lipitor side effects.
Miller says she began taking the medication in 2001, shortly after Pfizer Inc. bought out the company that owned the patent and new drug application for the statin medication. According to the Lipitor lawsuit, she was diagnosed with what she later found out might be Lipitor diabetes in May 2010. Women who have taken the drug reportedly had no information regarding the potential for insulin sensitivity and other problems caused by Lipitor.
Her Lipitor lawyer argues in the lawsuit that the new warning label for Lipitor, approved by the FDA in February 2012, still does not adequately warn of the risks of diabetes from Lipitor. The complaint argues that there is significant vagueness in the note that “[i]ncreases in HbA1c and fasting serum glucose levels have been reported with HMC-CoA reductase inhibitors.” Even with that, studies cited in other Lipitor diabetes lawsuits note that the risk is highest with Lipitor compared to other treatments to lower LDL cholesterol levels in the statin class.
In between Pfizer’s acquisition of Lipitor and Miller’s diagnosis of diabetes, the Lipitor lawsuit alleges that “despite its knowledge of data indicating that … use is causally related to the development of type-2 diabetes…, Pfizer promoted and marketed [its medication] as safe and effective.” As a result, the Mississippi woman’s lawsuit includes counts of failure to warn, negligence, breach of implied warranty, fraud, constructive fraud and unjust enrichment
