Merck Facing Mounting Lawsuit Over Fosamax Side Effects

Fosamax side effectsThousands of lawsuits have been filed to date on behalf of those who have suffered Fosamax side effects that were not previously warned of. The most common Fosamax side effect that is being reported on a consistent basis is that of an atypical femoral fracture. It is an unexpected side effect due to the fact that Fosamax is designed to help prevent weakening of the bones, and instead continued use is causing fractures as well as bone decaying in the jaw of several plaintiffs.

Fosamax was first approved by the Food & Drug Administration (FDA) in 1995 for the use in treatments involving diagnoses of osteoporosis or Paget’s – both of which are bone weakening diseases. Shortly after the medicine’s approval, claims started being filed against Merck for Fosamax side effects that were not disclosed on the labeling.

Merck to provide Expert Witnesses

In preparation for their defense, Merck has recently submitted a list of expert witnesses that it plans to call during the two Fosamax injury lawsuits that are scheduled to go to trial in 2013. The attorneys who are representing the plaintiffs will be scheduled soon to begin taking the depositions of these witnesses. Experts in the fields of epidemiology, bone biology, endocrinology and pharmacology will be interviewed by the plaintiffs’ representatives to not only test the opinions of these experts but also to gain insight into Merck’s defense strategy.
