Lawsuit Filed On Behalf of Yaz Stroke Victim Who Died

By Kimberly Mirando

Yaz Yasmin blood clotsA Yaz lawsuit has been filed on behalf of a 57-year-old woman who died after suffering a stroke caused by a Yaz blood clot. The lawsuit is seeking to hold manufacturer Bayer liable for her life-threatening injuries for failing to warn the public about the increased risk of dangerous blood clots from taking Yaz and its sister medications Yasmin, Beyaz and Ocella. These birth control pills can increase a user’s risk of developing blood clots by 74 percent, and have been linked to at least 50 deaths between 2004 and 2008.

According to the Yaz stroke lawsuit, filed on July 19, 2012, Maria Cunningham suffered severe injuries related to Yaz blood clots that caused her wrongful death. Cunningham allegedly suffered a cerebrovascular accident (or stroke) caused by a blood clot she developed in January 2004. The Yaz lawyer representing her family alleges the blood clot was caused by her use of Yaz.

Studies Link Yasmin/Yaz/Beyaz/Ocella to Dangerous Blood Clots

A recent study published in June 2012 found that birth control pills like Yaz, Yasmin, Beyaz and Ocella — which contain drospirenone — double a woman’s risk of stroke and heart attack compared to other hormonal contraceptives. Drospirenone is known to cause dangerous blood clot injuries such as pulmonary embolism and deep vein thrombosis, prompting the FDA in April 2012 to force manufacturers of these pills to update the warning label. According to the FDA, birth control pills like Yasmin, Yaz, Beyaz and Ocella triple a woman’s risk of getting blood clots.

Numerous wrongful death lawsuits have been filed by the families of Yaz blood clot victims who died of their injuries. Women who did not die of their injuries are often left with permanent complications and ongoing medical expenses that devastate their lives. Many have turned to Yaz injury lawyers to help pursue compensation from Bayer, which they say should be held responsible for its failure to conduct adequate safety studies prior to releasing Yaz and Yasmin, and for failing to adequately warn the public about the risks of blood clots.

10,000 Yasmin/Yaz/Beyaz/Ocella Lawsuits Filed

Thousands of injury lawsuits have been filed by Yasmin, Yaz, Beyaz and Ocella users who suffered severe side effects from the birth control pills, including blood clots, pulmonary embolism, deep vein thrombosis, heart attack and stroke. Plaintiffs in these lawsuits blame Bayer for their injuries, alleging the company was aware of the increased risk of blood clots but concealed this information from the public to increase its profits. Not only did Bayer conceal this information, it also deceptively marketed the pills as “just as safe” as other forms of birth control when it knew otherwise, some lawsuits say.

The majority of women who suffered Yaz side effects have chosen to sue Bayer individually and join the Yaz/Yasmin lawsuit MDL pending before U.S. District Judge David L. Herndon in the Southern District of Illinois. The Yaz/Yasmin MDL is different from a class action lawsuit because it allows each Plaintiff to retain her own attorney and seek compensation based on her individual injuries. Oftentimes, an award in an MDL settlement is much greater than an award received in a class action lawsuit settlement, which must be shared equally among all Class Members. However, that doesn’t mean a Yaz class action lawsuit should not be considered.

If you took Yaz, Yasmin, Ocella, Beyaz or another drospirenone-containing birth control pill and suffered a blood clot injury such as stroke, heart attack, pulmonary embolism or deep vein thrombosis, you may be able to pursue compensation for your injuries. A Yaz blood clot compensation specialist can provide a free consultation about your case and advise you whether a Yaz lawsuit, Yaz class action lawsuit or joining the Yaz/Yasmin MDL is best for you.
