Lawsuit Alleges NuvaRing Caused DVT, Pulmonary Embolism

Most women in the early 2000s depended on oral contraception as their birth control of choice. However, when Organon’s NuvaRing came onto the market, it seemed like a dream contraceptive. The plastic ring is inserted vaginally and left in for three weeks. It is then removed for a week to allow for a menstrual cycle before it is replaced with a new NuvaRing. However, numerous lawsuits have alleged that NuvaRing caused serious complications that Organon allegedly failed to warn the public about.
Carissa Archer, a Los Angeles resident, filed her NuvaRing lawsuit on Sept. 28, 2013, after she allegedly “suffered from a deep vein thrombosis and a pulmonary embolism in or about August 2010.”
Plaintiffs like Archer claim that this “warning” let the makers sidestep their responsibilities to adequately warn the public about NuvaRing side effects. Different birth control pills have different risks, so how can the NuvaRing have the same risks as birth control pills? Archer says that if she or her physician were properly warned about the risk of clots and embolisms, she either wouldn’t have used NuvaRing or would have been consistently checking for signs of blood clots.
Like other NuvaRing blood clot victims, Archer says “the safety information provided to the consumer was not derived primarily from studies of NuvaRing and, therefore, the package insert accompanying NuvaRing is misleading. Defendants failed to warn of the extent of the risk of stroke, venous thromboembolism, including Superficial Venous Thrombosis (SVT), Deep Vein Thrombosis (DVT) and Pulmonary Embolism (PE), stroke, and death associated with use of the novel combined contraceptive vaginal route of administration, NuvaRing.” She says she was led to believe that NuvaRing was safe when it wasn’t.
“Defendants negligently and/or recklessly marketed the NuvaRing as a novel vaginal delivery system, and placed the product into the stream of commerce without conducting adequate tests to regulate the exposure and/or release rates of estrogen and Progestin to a user, including Plaintiff, of such product,” notes Archer’s NuvaRing lawsuit.
A Fair Resolution
Archer has filed an individual NuvaRing lawsuit but she may have her case transferred to multidistrict litigation (MDL) in the future. She’s suing the makers and distributors of the device for defective manufacturing, defective design, defect due to inadequate warning, breach of warranty, negligence, misrepresentation and/or fraud, violation of California consumer protection statutes and successor liability.

Hi. I just suffered a seroius Saddle Pulmonary Embolism. The clot came from my leg. I have been on Nua ring since the summer..it happen Nov.8th. I almost died. If this causes these issues. It needs to be removed. I am still on recovery. They said it was caused by birth control. I was told not to use it again. Its going on 6 months and still recogering now with other issues now feom the blood clots.
