Plaintiff Nadine B., a Louisiana resident, recently filed a lawsuit against Daiichi Sankyo, alleging that she suffered serious side effects of Benicar.
According to the Benicar lawsuit, Nadine began taking Benicar at the direction of her doctor in September 2010. However, she began suffering from severe side effects of Benicar after starting the drug.
These side effects of Benicar include a number of gastrointestinal problems including lymphocytic colitis, chronic diarrhea, hypokalemia, muscle weakness, fatigue, and olmesartan-induced enteropathy. The complaint also claims that the use of the drug and its subsequent injuries have resulted in medical expenses that will continue for some time.
The complaint notes that, given the risk of serious side effects of Benicar, Daiichi’s drug is “unreasonably dangerous.”
The plaintiff filed her May 30 complaint in the U.S. District Court for the District of New Jersey.
The Daiichi lawsuit over side effects of Benicar was filed on multiple counts, including defective design, failure to warn, gross negligence, negligent misrepresentation and design, fraudulent concealment, fraud, breach of express and implied warranties, and several others. The plaintiff’s husband also filed on one count of loss of consortium.
Benicar Background
The popular blood pressure medication Benicar (also known by its generic name, olmesartan medoxomil) is manufactured by Daiichi Sankyo and was approved by the U.S. Food and Drug Administration (FDA) to treat hypertension back in 2002. Benicar has quickly become one of the most popular blood pressure drugs currently available.
Despite its popularity, Benicar has actually been linked with a number of serious side effects. The risk of complications linked with olmesartan drugs may affect a large portion of patients.
Indeed, nearly 2 million patients fill prescriptions for olmesartan drugs like Benicar each year, a considerable portion of the blood pressure drug market.
Side Effects of Benicar
A number of studies have shown a number of side effects of Benicar, including serious gastrointestinal issues. Possible side effects of Benicar include the following:
- Villous atrophy
- Sprue-like enteropathy
- Colitis
- Kidney failure
- Malabsorption
- Malnutrition
- Dehydration
- Diarrhea
- Vomiting/Nausea
- Abdominal pain
Filing a Lawsuit Over Side Effects of Benicar
A growing number of patients like Nadine who have been affected by these side effects of Benicar are filing lawsuits against the drug’s manufacturer, Daiichi Sankyo.
So far, Daiichi has been targeted in over 1,250 lawsuits alleging serious side effects of Benicar. Plaintiffs allege that Daiichi either knew or should have known about these risks, yet failed to give patients, the public, and the medical community adequate warning, instead continuing to market the drug as safe and effective.
If you or someone you love has suffered from side effects of Benicar, you may be able to file a Benicar lawsuit. Filing a lawsuit cannot take away the pain and suffering of side effects of Benicar, but it can help to alleviate the financial burden of medical bills or even lost wages.
