An Indiana resident recently filed a lawsuit against Johnson & Johnson subsidiary Janssen Pharmaceuticals alleging kidney failure from Invokana.
The plaintiff, Joshua H., began taking Invokana in January 2015, continuing usage of the drug for only a short period of time, until March 2015. Joshua was prescribed Invokana in order to treat his diabetes by reducing his blood sugar levels.
The Invokana lawsuit alleges that Janssen made claims about the safety and efficacy of Invokana that led to the plaintiff trusting the drug. However, the plaintiff ended up suffering from kidney failure from Invokana after only a few weeks of use.
In response, Joshua filed a claim against Janssen Pharmaceuticals. According to his Invokana lawsuit, the kidney failure from Invokana was a direct result of using the drug and was preventable.
However, due to Janssen’s marketing of the drug and concealment of its risks, including the risk of kidney failure from Invokana, the plaintiff says he ingested the drug and was thereby injured.
Joshua’s claim and other Invokana lawsuits like it allege that Janssen not only failed to warn the plaintiff, the medical community and other consumers about Invokana’s side effects including kidney failure from Invokana, but voluntarily misrepresented Invokana’s safety and efficacy.
The Janssen lawsuit over kidney failure from Invokana was filed on multiple counts including manufacturing defect, defective design, failure to warn, breach of express and implied warranties, negligence, fraudulent misrepresentation and concealment and punitive damages, among others.
Invokana Background
Invokana (also known by its generic name, canagliflozin) is a relatively new drug, first brought onto the market as a diabetes treatment in 2013. Invokana is manufactured by Janssen Pharmaceuticals, a subsidiary of pharmaceutical giant Johnson & Johnson.
Invokana is one of several major diabetes drugs known as sodium-glucose co-transporter 2 inhibitors, or SGLT2 inhibitors, a class of drugs that has grown to be widely used in recent years.
The U.S. Food and Drug Administration (FDA) is receiving a growing number of adverse event reports regarding the drug, and has required Janssen to add a series of warnings to the Invokana label about severe Invokana defects and injuries.
The warning urged users to be aware of diabetic ketoacidosis symptoms like abdominal pain, fatigue, nausea, respiratory problems and vomiting.
Filing a Lawsuit over Invokana Kidney Damage
Invokana lawsuits claim that Janssen failed to adequately warn about complications like kidney failure from Invokana and, in some cases, claim that the company actively withheld information about Invokana risks from both the medical community and the general public.
