A growing number of patients say they have developed Nexium kidney damage and have joined growing multidistrict litigation (MDL) alleging AstraZeneca and other pharmaceutical companies failed to warn the general public.
One of the most recent Nexium wrongful death lawsuits was filed by a man from Florida, who is filing on behalf of a deceased loved one and other family members.
Plaintiff Nicholas O. filed this Nexium wrongful death lawsuit on behalf of the late Carl O. and his wife Patricia O., as well as their surviving family members. The lawsuit contends that their loved one was deprived of the opportunity to make an informed medical decision.
According to the claim, Carl had used Nexium for typical treatment purposes between 2009 to 2017 and had no reason to believe he was at risk for any serious reactions.
However, Carl allegedly developed acute kidney injury and eventually died. Nicholas opted to file legal action against AstraZeneca, after discovering other patients had suffered similar complications.
Nexium Kidney Damage Correlation
Nexium is part of the proton pump inhibitor (PPI) drug family, which works by limiting the amount of digestive fluids produced in the stomach.
Nexium helps treat acid reflux, stomach ulcers, and other conditions that are caused by too much stomach acid. PPIs are among some of the most popular treatment medications in the United States, with over 15 million users in the country. The total number of usres is likely to be much higher due to the availability of over the counter versions.
Patients who use Nexium and other PPIs have been linked to an increased risk of kidney problems in recent studies.
According to a recent study published in the Journal of the American Society of Nephrology, which reportedly analyzed patients who were either prescribed PPIs or H2 receptor blockers. The results of the study reportedly found that PPI patients faced a 96 percent increased risk of kidney failure and a 28 percent increased risk of chronic kidney damage, compared to the other treatment group.
Another study published in February 2016 in the Journal of the American Medical Association (JAMA), had reportedly found a link between PPIs and chronic kidney disease. This study was reportedly conducted after other studies suggested these medications could cause acute interstitial nephritis, which is a condition known to evolve into kidney failure.
The FDA approved a label update to include the risk of kidney damage in 2014, which stated the medication could potentially cause interstitial nephritis. Even though Nexium kidney damage can be potentially fatal, AstraZeneca allegedly failed to warn their users, plaintiffs claim.
At all times relevant, Carl allegedly relied on the marketing materials and product information provided by the company. Nicholas states that Carl would not have used Nexium if he had been aware of the risk of potentially fatal kidney damage.
Nicholas’ Nexium wrongful death lawsuit is joining MDL No. 2789, where it will be streamlined through the litigation process and will avoid potential problems like conflicting rulings from different judges. Nicholas is seeking multiple damages in his claim, including counts of wrongful death, negligence, and failure to warn.
The Wrongful Death Lawsuit is Case 2:19-cv-00592-CCC-MF, in the U.S. District Court of New Jersey.
