GranuFlo Wrongful Death Lawsuit Filed Over Fatal Heart Attacks
By Andrea Gressman
Fresenius Medical Care has been hit with a new wrongful death lawsuit alleging its dialysis product GranuFlo caused the plaintiff’s wife to suffer two heart attacks, which ultimately lead to her death.
Armando Rodriquez alleges in the GranuFlo lawsuit that his wife, Boni Sue Rodriguez, was administered GranuFlo between December of 2009 and December of 2011 during hemodialysis treatments. The GranuFlo lawsuit alleges Mrs. Rodriguez suffered a heart attack in January 2011. Nearly 11 months later, she suffered a second heart attack, which caused her death.
GranuFlo was recalled in 2012 after the FDA discovered it had caused hundreds of dialysis patients to suffer cardiac arrest and die.
Mr. Rodriguez claims in the GranuFlo lawsuit that his wife died unnecessarily and that her death could have been prevented if only the drug manufacturer had provided a proper warning to the medical staff and patients about the side effects of GranuFlo. The plaintiff seeks both compensatory and punitive damages due to his wife’s death.
GranuFlo Overdose Causes Deadly Side Effects
Hundreds of thousands of people require dialysis treatment every year. The reason so many receive dialysis is to clear the waste and toxins from the individual’s blood when their kidneys are no longer able to perform this function. However, during this process the patient’s acid levels must be maintained at a healthy level, and that is where products like GranuFlo and NaturaLyte come in.
NaturaLyte and GranuFlo use different ingredients than other comparable products, which makes them far more potent in their concentrated form. However, the medical community was not aware of this fact and mixed the concentrates at the same level as they would other products of this kind. As a result, patients were overdosed, which caused severe and deadly side effects. The most common side effect is cardiac arrest, which often resulted in death as it did with Mr. Rodriguez’s wife.
There was an internal memo issued by Fresenius in November of 2011 stating the severity of the situation. However, this information was only provided to the dialysis clinics that Fresenius owned and not the other dialysis treatment centers that still used GranuFlo and NaturaLyte products. As a result of this information being withheld there were thousands of patients that were continually put at risk until the FDA issued a recall in March of 2012.
