Byetta Pancreatic Cancer Lawsuit Seeks Damages for Husband’s Death

Texas resident Velia Flores has filed a lawsuit in California federal court against Amylin Pharmaceuticals and Eli Lilly over the death of her husband. The lawsuit alleges her husband died as a result of the diabetes drug Byetta, which caused him to develop pancreatic cancer.
Byetta belongs to a class of diabetes drugs called incretin mimetics. These drugs work by controlling the hormones the body uses to regulate blood sugar, helping diabetes control their blood glucose levels. However, the Byetta lawsuit asserts that various studies have linked Byetta and related incretin mimetics to pancreatitis and several forms of cancer, including pancreatic cancer.
The late Mr. Flores began taking Byetta in 2009, and continued to take the drug up through June 2011. Flores was prescribed Byetta to help control his blood sugar levels, as he had type-2 diabetes. In May of 2011, Flores was diagnosed with pancreatic cancer. Though only diagnosed in May of that year, Flores passed away from the Byetta pancreatic cancer in July of 2011.
The Byetta lawsuit holds that the manufacturers of the drug were aware – or reasonably should have been aware — of the risks associated with Byetta side effects based on scientific literature as well as required postmarket surveillance. The Byetta lawsuit cites a number of research papers that have found evidence of a link between Byetta (and other incretin mimetics) and various forms of cancer. These studies include data from epidemiological surveys, as well as clinical studies and animal trials. Despite this, the manufacturers continued to produce, market and distribute Byetta.
The Byetta lawsuit alleges that the pharmaceutical companies that produced Byetta are liable for Mr. Flores’s death. The lawsuit holds that their actions were negligent in that they created a situation wherein a dangerous drug was available to the public. The Byetta lawsuit further alleges that the manufacturers of Byetta were fraudulent in that they concealed the risks associated with this drug.
Mrs. Flores asserts that her husband would not have selected this drug had he known about the risk of pancreatic cancer associated with it.
