Arizona Woman Sues Pfizer in New Lipitor Diabetes Lawsuit

Michelle Murphy is suing Pfizer Inc. alleging that the company’s popular cholesterol drug Lipitor led to her to develop type-2 diabetes. She is seeking compensatory and punitive damages because the drug maker failed to include diabetes as a potential side effect of Lipitor, according to her lawsuit filed July 15, 2013.
Her Lipitor lawsuit attorney notes in the complaint that Murphy began taking the medication in 2003 and continued to do so until prior to beginning filing her lawsuit. Murphy developed type-2 diabetes in 2004 and was unaware that there was a possible link between her diagnosis and the cholesterol drug she was taking.
According to the Lipitor lawsuit, Pfizer updated the drug safety information in 2012 to include the potential for “increases in HbA1c and fasting serum glucose levels reported with HMC-CoA reductase inhibitors, including [the medication].” However, Murphy and others may not know that the jargon actually points to risk factors involved with Lipitor type-2 diabetes side effects.
Prior to that change, studies and pre-approval data should have led to labeling changes and modification of the drug safety information years prior to the change, and considerably closer to the approval date of Lipitor in 1996, according to Murphy’s Lipitor diabetes attorney. By not doing so, the company failed to properly advise patients of the risks.
In addition, clinical reviews that have continue to be conducted demonstrate that there is a link between the statin and others in its class and issues regarding serum glucose levels that can lead to a type-2 diabetes diagnosis.
The Lipitor type-2 diabetes lawsuit is Michelle E. Murphy v. Pfizer Inc., Case No. 13-cv-013420, U.S. District Court, District of Arizona. Counts include failure to warn, negligence, breach of warranties, fraud and unjust enrichment.
