76 New Yasmin/Yaz/Beyaz Lawsuits Filed Since July 2012

Yaz Yasmin blood clotsClose to 80 new Yasmin/Yaz/Beyaz lawsuits have been filed since July 1, 2012 in the multi-district litigation (MDL) in East St. Louis federal court, where nearly 9,800 cases are currently pending. The flurry of lawsuits was sparked by the recent announcement by the judge overseeing the Yaz lawsuit MDL that he expects to reach settlements in the majority of cases soon. About 1,500 Yasmin/Yaz/Beyaz lawsuits have already been settled, with Bayer agreeing to pay out more than $300 million in Yaz lawsuit settlements. Plaintiffs in the lawsuits claim the Yasmin-line of birth control pills caused heart attacks, strokes, pulmonary embolisms, deep vein thrombosis and other blood clot injuries. These side effects are similar to those claimed by Plaintiffs in Ocella lawsuits.
 

Court documents show at least 76 Yasmin/Yaz/Beyaz lawsuits have been filed in the Yaz lawsuit MDL since the beginning of July 2012. Plaintiffs accuse Bayer and other drug manufacturers of failing to adequately research the birth control pills before placing them on the market, and concealing the risks of Yasmin/Yaz/Beyaz side effects. While these lawsuits cite numerous Yasmin/Yaz/Beyaz side effects, including heart attack and stroke, the only cases currently being settled are those involving claims of deep vein thrombosis, pulmonary embolism and other similar blood clot injuries. Last month, U.S. District Judge David Herndon, who is overseeing the Yaz lawsuit MDL, said the cases “have been settling at a consistent rate” and he expects the rest of the Yasmin/Yaz lawsuits to be resolved “some period of time here soon.” About 1,500 Yaz lawsuit settlement have been reached since February, paying out an average award of about $214,000 per Plaintiff. Judge Herndon ordered a special mediator to facilitate the Yasmin settlement process, who predicted more Yasmin/Yaz/Beyaz lawsuits will likely be filed once word gets out that the MDL cases are settling for substantial amounts. Based on the number of new Yasmin/Yaz/Beyaz lawsuits filed in July 2012 alone, his prediction appears to be track.
 
The Yasmin/Yaz/Beyaz lawsuit MDL allows thousands of Yasmin, Yaz and Beyaz users to file lawsuits under the jurisdiction of one judge, retain their own attorney, and receive an individual award if the case is won or settled. If an MDL settlement is reached, the award they would receive is typically much larger than any individual award expected in a Yasmin/Yaz class action lawsuit.
