$3.9M Mesothelioma Asbestos Lawsuit Settlement Awarded to Marine
By Andrea Gressman
Two weeks prior to Mesothelioma Awareness Day, which was September 26, 2012 this year, it was proudly announced that an asbestos mesothelioma lawsuit Plaintiffs’ jury verdict of $3.9 million in damages was given to the family of deceased U.S. Merchant Marine, William LaParl of Michigan, who died of mesothelioma.
The mesothelioma lawsuit trial took place on Friday, September 7, 2012. An eight-member jury found the four companies involved — Oglebay Norton Company, Columbia Transport Company, Interlake Steamship Company, and Pringle Transit Company – were guilty of actions ultimately resulting in William LaParl’s death at the age of 78. After 35 years of service in the U.S. Merchant Marines, LaParl retired. He was then diagnosed with asbestos exposure mesothelioma in July 2006. He died the following month.
According to the mesothelioma asbestos lawsuit, LaParl’s mesothelioma and death were a result of negligence on the part of the Defendants. This case differed from the Asbestos Products Liability Litigation (MDL No. 875), where 3,500 asbestos lawsuits involving Merchant Marines are currently pending.
Mesothelioma Awareness Day Used to Advocate for Mesothelioma Victims
Many have used the Mesothelioma Awareness Day to speak of the dangers of asbestos exposure and its fatal impact on victims, including William LaParl. It is evident that the recent jury verdict in LaParl’s asbestos mesothelioma lawsuit settlement has sent a strong, clear message of the penalties and consequences of negligence of companies who ignore worker health and safety standards or concerns.
In the United States and Canada alone, around 3,000 people are diagnosed with mesothelioma each year. Often the victims are military service members, workers, veterans, and family members who worked in hazardous conditions where exposure to asbestos was highly likely. No cure for mesothelioma exists today and those diagnosed with the disease have a lifespan of less than one year in most situations.
Judge Harry Hanna presided over the asbestos mesothelioma lawsuit settlement of Delores A. LaParl, Personal Representative of the Estate of William S. LaParl, deceased v. Columbia Trans. Co., et al (No. CV-08-667485) in the Court of Common Pleas in Cuyahoga County, Ohio, Civil Division.
