
A Florida personal injury lawsuit filed by a man who was injured in a motorcycle accident has resulted in an award of more than $411 million for the victim and his family.
About the Florida Motorcycle Crash Lawsuit
Plaintiff Duane W. claims that he was riding his motorcycle on Florida’s Interstate 10 in late July 2018, when he encountered a large automobile crash on the highway. In an attempt to avoid crashing into the pileup of vehicles, Duane claims that he swerved into the emergency lane.
However, a truck was stopped in the emergency lane without its lights on, and Duane’s motorcycle collided with the stopped vehicle. Duane claims that the collision caused him to be thrown from the motorcycle and into the median, resulting in serious injuries.
According to the Tallahassee Democrat, more than 45 vehicles were involved in the pileup, which is believed to have been initially caused by a combination of poor weather conditions, as well as speeding by at least one commercial truck driver.
Duane claims in his motorcycle crash lawsuit that the actions of the speeding driver resulted in his accident. The truck driver drove for trucking company Top Auto Express, which did not participate in the trial. At least eight other people involved in the pile up were taken to the hospital due to injuries.
According to Duane, the motorcycle accident left him with permanent and life changing injuries. In addition to breaking both sides of his pelvis in the crash, his pelvis was also separated from his spine during the crash. He claims that his injuries include severe colon and urethra damage, which have resulted in permanent incontinence, as well as the loss of sexual function. Additionally, he has lost much of his mobility, and claims that he can only walk with the aid of an arm crutch.
