two red semi trucks on the highwayA new lawsuit was filed after a commercial vehicle accident that the victim says was the responsibility of a negligent driver.

Plaintiff Arthur B. filed the lawsuit against Fentin W. Miller, alleging that the driver, as well as the trucking company he works for, is responsible for his injuries. Arthur is seeking compensatory damages for the injuries he suffered from the April 5, 2018 crash.

Arthur says that his vehicle slammed into the commercial vehicle that was attempting to make a left turn. Arthur alleges that the defendant failed to yield the right of way to him causing the commercial vehicle accident.

Arthur’s lawsuit states that the defendant was an employee of another defendant, Veritiv Operating Company. Arthur is pursuing a negligence claim against both the individual driver and the employer company of that truck driver.

Due to the size and weight of big trucks, a commercial vehicle accident can carry more significant injuries and property damage risks for those in regular passenger vehicles. The commercial vehicle accident lawsuit says that the collision that caused the plaintiff’s injuries occurred due to the negligence of the employer company acting through its employee.

The commercial vehicle accident lawsuit alleges that the defendants are responsible on multiple counts, including negligently failing to yield the right of way, failing to sound a warning of his approach or to reduce speed, being inattentive to the roadway, failing to train the individual driver in the safe operation of that commercial vehicle, negligent operation of the commercial vehicle at a high rate of speed under the circumstances, and general failure to control the motor vehicle.

The lawsuit also accuses the company employing the individual driver as responsible for improper hiring or training because they should have known about his history of unsafe operation of these vehicles.

The commercial vehicle accident lawsuit says that the plaintiff’s life has been changed significantly due to being involved in the accident, including great pain of the mind and body that he will continue to suffer, fractures of the left arm and left leg that prompted surgery and extensive medical treatment, and incurred medical expenses and significant disability due to the damage directly as a result of the accident.

The lawsuit argues that the defendant, both the individual driver and the truck company employing him, should be held accountable for the injuries he sustained and alleges significant and life changing damages associated with the accident that will forever alter the victim’s ability to move on with his life.

The Commercial Vehicle Accident Lawsuit is Case No. 4:18-cv-00997-ODS in the Circuit Court of Clay County, State of Missouri.
