Mandalay Bay Resort & Casino Found at Fault in Hotel Personal Injury LawsuitThe Mandalay Bay Resort & Casino Hotel was recently found to be at fault in a personal injury lawsuit which alleged that the resort’s negligence allowed for a 400 pound sign to fall on top onto a hotel guest.

The hotel personal injury lawsuit alleged Mandalay Bay had failed to confirm that the sign was properly attached, and did not maintain a safe environment for their employees or customers.

A Las Vegas jury had found Mandalay Bay liable in the hotel personal injury lawsuit, but the damages awarded was significantly smaller than the amount requested by the claimant’s attorney. An award of $524,068 has been granted to the claimant, far below the original alleged damages of $35.1 million.

The jury awarded the claimant $114,068 for medical expenses, $100,000 for his future medical expenses, $150,000 for past pain and suffering, and $160,000 for any future pain and suffering.

The hotel personal injury lawsuit was filed by plaintiff Glenn R., who alleged the hotel’s lack of safety protocols and insufficiently trained staff had contributed to the incident of the falling sign.

The accident in question involves a large “column header” free standing sign, which reportedly blew over and fell on Glenn from a gust of wind on June 24, 2013.

Overview of Hotel Personal Injury Lawsuit Deliberation

Initially, Glenn and his wife Gayle asked for a jury award in the amount of $35.1 million in damages, including $10 million for past pain and suffering, and $20 million for future and suffering, along with any additional compensation for lost wages.

Glenn’s attorney argued for this amount alleging his client had suffered traumatic brain damage, which caused memory issues and cognitive impairment and will most likely have to undergo surgery for spinal and knee injuries. These injuries reportedly impacted his personal life and career as a celebrity talent booking agency.

However, medical records show that Glenn had no bleeding in his brain and did not have any bleeding or bumps on the outside of his head. As for the work compensation damages, the hotel personal injury lawsuit states that Glenn had been paid the same salary before and after the accident.

However, the jury found that Mandalay Bay had been negligent and was liable for Glenn’s injuries from the sign. The trial lasted 13 days, with Mandalay Bay’s parent company MGM Resorts International stating that it respects the jury’s decision regarding the hotel personal injury lawsuit, according to Law360.

Personal injury law pertains to legal disputes involving one party suffering harm or injuries due to an accident that could have been prevented if certain actions were taken. This applies to resort companies like MGM Resorts International and their Mandalay Bay Resort locations, which must be kept up in a sufficient manner to ensure a safe environment. This means confirming that the floors are clean and that no dangerous objects could fall and injury someone.

People who file a personal injury claim can seek damages for medical compensation and lost work depending on the severity of the injuries suffered.

This Hotel Personal Injury Lawsuit is Case No. A-17-750846-C, in the Eighth District Court of Nevada.
