A $1.853 million Vonachen Services settlement resolves claims the company collected and stored employee biometrics without complying with Illinois regulations.

The settlement benefits individuals who worked at one of Vonachen Services’ Illinois facilities and whose biometric identifiers the company collected via a timekeeping system between Nov. 1, 2014, and Jan. 18, 2024.

Vonachen employees claim the company violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting their biometrics without the proper consent or disclosures. BIPA limits when and how companies can collect biometrics even through otherwise legal timekeeping systems, such as fingerprint time clocks.

Vonachen Services is a janitorial, health care and logistics service headquartered in Illinois. 

Vonachen hasn’t admitted any wrongdoing but agreed to the $1.853 million settlement to resolve the BIPA class action lawsuit.

Under the terms of the Vonachen Services settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of participating class members, but class counsel estimates each class member could receive $780.

The deadline for exclusion and objection is July 8, 2024.

The final approval hearing for the settlement is scheduled for Aug. 22, 2024.

No claim form is required to benefit from the Vonachen Services settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
