BMW, Mazda, Nissan, Subaru and Toyota agreed to an air bag class action lawsuit settlement resolving claims related to a defect in Takata auto air bags.
These air bag class action settlements will resolve allegations the car companies manufactured, distributed or sold vehicles that contain Takata air bags with allegedly defective deflators that, when deployed, could cause the airbag to rupture and expel debris or shrapnel into the vehicle. The plaintiffs allege they sustained economic losses as a result of the defective Takata air bags.
Takata has reportedly reached a settlement with the U.S. Department of Justice that would require the air bag maker to pay up to $1 billion in penalties over allegations of criminal wrongdoing.
The car companies have recalled millions of vehicles that contained the allegedly defective Takata air bags. The Takata air bags are allegedly to blame for at least 10 deaths and more than 100 injuries worldwide.
The defendants deny any wrongdoing but agreed to a settlement in the Takata air bag class action lawsuits to avoid the burden, risk and expense of ongoing litigation.
If you would like to opt out of the BMW, Mazda, Subaru or Toyota auto air bags class action settlements, you must do so no later than Sept. 25, 2017.
Information about the Nissan auto air bags class action settlement has not yet been posted, but the Takata class action lawsuit settlement website will be updated when the information becomes available.
Who’s Eligible
Class Members include anyone who owned or leased any of the subject vehicles in the United States as of June 9, 2017, and anyone who formerly owned and/or leased the subject vehicles and who sold or returned the subject vehicles between April 11, 2013 and June 9, 2017.

NOTE: These Takata airbag settlements do not involved claims for personal injury or property damage to any property other than the subject vehicles.

The Takata airbag settlements offer several potential benefits to Class Members, including:

- Out-of-pocket claims process

- Potential residual distribution

Proof of Purchase
To be eligible for a payment of out-of-pocket claims or residual distribution, Class Members must bring their vehicles to a dealership for the Takata Airbag Recall Remedy (if they have not already done so), unless they sold or returned the subject vehicle between April 11, 2013 and June 9, 2017.
Class Members must either file a registration/claim for reimbursement for the air bag-related expenses they incurred or file a registration/claim for a residual distribution of up to $250.

UPDATE: On November 1, 2017, the court granted final approval to the Toyota, BMW, Subaru, and Mazda class action settlements.
UPDATE 2, July 20, 2018: Ford Motor Co has also agreed to settle economic loss class action lawsuits related to the Takata airbag defect, and is now included in the settlement.
UPDATE 3: On Sept. 5, 2018, Ford’s nearly $300 million settlement agreement for its part in a Takata airbag defect class action lawsuit was preliminarily approved by a federal judge.
UPDATE 4: On April 7, 2020, Top Class Actions viewers started receiving checks in the mail from the Takata airbags class action settlement worth as much as $400. Congratulations to everyone who filed a claim and got PAID!

ADD ME I HAVE A 2017 BMW
I had a 2011 Kia Soul. A deer hit it by the driver door. The car was a 100% total loss. The airbag never activated. Can I mt name to this claim and file a class action lawsuit?
My son has a 2006 Mazda 6. He received a notice to take his car in and get the airbag fixed/changed. He did so threw a dealer. A couple of months ago, was in a pretty bad accident and his airbag never deployed. Can anything be done, said, filed, whatever?
I have a 2010 Mazda 6 and it’s included jn the lawsuit. I havent recd any type or form.of settlement
I think it’s a ripoff.
My Honda Accord was on the list for airbag recall. My car was stolen and in an accident and it was a total loss.
I got $72.04 for one Honda CRV and nothing for my second eligible CRV. This was over two years ago. I contacted this Settlement Administrator on multiple occasions to get an explanation. Instead, I got the run around with no real explanation except my vehicle is eligible if funds are available. So they kept the rest of the money or they don’t know how to administer the funds. Either way, don’t expect anything close to $250.
